A Peruvian government office refused my procedure or asked for something not in its TUPA: what can I do?

A public body may only require what its TUPA lists. If it refuses your procedure or asks for more, get the answer in writing, file your request at the mesa de partes, use the Libro de Reclamaciones or a complaint about procedural defects, and go to Indecopi or the Defensoría del Pueblo.

Article 218.2 sets fifteen peremptory days. That they run from notification and count business days comes from the TUO's general rules on time limits, which this page does not quote. It only applies if there is a written decision: a verbal refusal at the counter is not a notified decision.

The rule: only what is in the TUPA

Every Peruvian public body publishes a TUPA (Texto Único de Procedimientos Administrativos): the list of its procedures, their requirements and their fees. The TUO (consolidated text) of Law 27444, Peru’s general administrative procedure law, says clear things about it:

  • Procedures and requirements are set in a legal rule: a supreme decree or higher, a regional or municipal ordinance, among others (art. 40.1). No new procedures or requirements can be created in the TUPA itself (art. 40.3).
  • Public bodies may only require documents, information or fees that meet those rules, and «the official who acts otherwise is liable» (art. 40.4).

In practice, this means the counter officer does not decide the requirements. If you are asked for something that is not in the TUPA or on the official procedure page, you have grounds to ask that the demand be dropped. The rule does not guarantee you will win on the spot; it gives you something to point to.

Typical cases

  • Requiring another person to come. For example, insisting that the Peruvian parent accompany a child for a passport when the rule says «at least one of their parents». This is covered in foreign parent of a Peruvian child.
  • Asking for a document the State already has. Indecopi found it an illegal bureaucratic barrier for the Interior Ministry and Migraciones to require the Interpol record check (ficha de canje internacional) to apply for nationality, because another body in the same sector issues it (Resolution 0382-2022/SEL-INDECOPI, according to Indecopi’s official press release). Note: Migraciones’ gob.pe page for naturalization (last updated 27 January 2026) says a court injunction suspended that effect and that Migraciones has asked for the document again since 14 June 2024.   • Asking for a copy of your DNI at a public office, or for documents that are not on the list.
  • Refusing to accept your application because «something is missing».

First step: get it in writing

The Constitution (art. 2, para. 20) and the TUO (art. 117.3) recognise the right to petition in writing and to receive a written answer within the legal time limit. A verbal refusal at the counter leaves no trace. So:

  • Ask for the exact reason and the rule. Note the date, time, office and name.
  • File your request at the mesa de partes (filing desk). Article 136.1 of the TUO says all documents must be accepted, even if they fail to meet requirements. The office can flag problems and give you time to fix them, but it cannot turn the filing away at the door.
  • If the body issues a decision, it must give its reasons (TUO, art. 3, para. 4). If it does not explain them, point that out in your appeal.

A public body’s complaints book is different from a shop’s: it has its own rule and its own deadline. Do not confuse it with the consumer complaints book.

Indecopi and bureaucratic barriers

Legislative Decree 1256, as amended by Law 31755, defines a bureaucratic barrier as a demand, requirement, limitation, prohibition or charge imposed by a public body that may affect people going through administrative procedures. The same definition makes clear that a requirement is not illegal just because it exists.

Indecopi’s Bureaucratic Barriers Commission, and its Chamber on appeal, review decisions, regulations and also material conduct (actuaciones materiales), including that of municipalities and regional governments (art. 6.1). If they find the barrier illegal or unreasonable in a case you started, they order that it not be applied to you (art. 10.1). Since Law 32587 (published 8 May 2026), if they find illegal a barrier contained in a regulation (disposición administrativa) or in material conduct, they order that it not be applied to anyone (art. 8.1, efectos generales). The complaint carries a fee of S/ 507.60 (payment code 307001270), according to Indecopi’s 2026 TUPA. This route is most useful when the demand is repeated, not only when it happened to you once. The Defensoría del Pueblo

The Defensoría (Ombudsman) oversees the public administration and takes complaints free of charge. What it can and cannot do is covered in how to complain to the Ombudsman.

What these routes do not do

None of these routes gets you the procedure on the spot. A reclamo forces an answer, a queja forces the superior to review, an appeal forces a fresh decision, and Indecopi can declare that the demand does not apply to you. If the refusal has a real basis, for example because your document has expired, the fix is to correct that first.

Frequently asked questions

How do I know whether a requirement is in the TUPA?

Look up the agency's TUPA and the procedure page on gob.pe, and compare the list of requirements with what you are being asked for. If the agency also has a procedure page on gob.pe, print it: it is the version counter staff recognise fastest.

What is the difference between a reclamo, a queja and a recurso?

A reclamo in the Libro de Reclamaciones records your dissatisfaction with the service (D.S. 007-2020-PCM, art. 4.1). A queja por defectos de tramitación goes to the officer's superior when a procedure stalls or a step is skipped (TUO, art. 169). A recurso de reconsideración or apelación challenges a written decision you have already been notified of (TUO, art. 218).

Does a complaint to Indecopi get me the procedure right away?

No. It is a proceeding with its own timeline. If the Commission finds the barrier illegal or unreasonable, it orders that it not be applied to you (L.D. 1256, art. 10.1). It does not carry out your procedure in the agency's place.

Do these routes work if I'm a foreigner?

The rules cited do not distinguish by nationality: they speak of «administrados», «las personas» or «el interesado». The right to petition in writing and to receive a written answer is in the Constitution (art. 2, para. 20) and in the TUO of Law 27444 (art. 117).
