Privacy policy

This site is designed to collect as little as possible. There is no user registration and there are no comments. Reading the pages sends no data about you to our servers (if you click a link to a document or a tool, only that click is added to a weekly total per page), and using the calculators sends nothing you type: only a notice that the tool gave a result, which is added to a weekly total per tool and language with no data about you. The only forms that store data are the document assistant, the draft review, the lawyer contact form and the error-report form, and only for the periods set out below.

1. Controller

Lyredigital S.A.C., registered at Lima, Perú, owner and operator of misderechos.pe.

Contact for personal data matters: privacidad@misderechos.pe.

2. What is processed

  • Technical browsing data (IP address, cookie identifiers, device type, pages visited). Under Ley 29733 and Decreto Supremo 016-2024-JUS, online identifiers are personal data. They are used to measure visits and, if you accept, to show advertising.
  • Local preferences (chosen language, cookie consent). Stored in your own browser, never sent to our servers.
  • Emails you send us voluntarily. Used only to reply.
  • Document assistant (complaints, letters and requests). What you type into the form, to build the document. If you pay, the email you give for the receipt is sent to Culqi, which processes the payment and issues the receipt; Mis Derechos does not keep it. The document comes from a fixed template and is always in Spanish. If you use the assistant in English, the descriptions you write are sent to Google's Gemini API to be translated into Spanish (point 5), except any that look like they contain a personal identifier, which you translate yourself; you check every translation before you file the document. Used in Spanish, the assistant uses no artificial intelligence.
  • Letter packs. Paying for a pack generates a redemption code. We keep the order (which pack, the price, the language and the code) and, separately, the code with the uses it has left and its expiry date. Neither holds your name or your email: the receipt email goes to Culqi and Mis Derechos does not keep it. Each letter you build with the code follows the document-assistant process described above.
  • Draft review. The text you paste, the review result, and your IP address, used as a daily usage counter. If you pay, the receipt email is sent to Culqi and Mis Derechos does not keep it.
  • Lawyer contact. Your name, email or phone, the type of case and what you tell us.
  • Error reports (the corrections form). The page, what it says, what it should say and the source you give. Your email is optional, and if you tick "anonymous" it is not stored even if you typed it. To limit abuse we count how many reports one connection sends in a day; for that we do not store the IP address as it is, only a code derived from it and the date.

What is required. The details each form marks as required are needed to provide the service: without them we cannot build the document, review the draft, pass your case to a lawyer or check your report. Everything else, including the email on the corrections form, is optional and leaving it out has no consequence.

3. Cookies and consent

Once advertising is active you will see a banner with two options: "Essential only" and "Accept". On "Essential only" no advertising or third-party measurement cookie is loaded; Google's script is never even requested.

You can change your mind at any time through Cookie preferences in the footer of any page. Withdrawing consent reloads the page, because a script already loaded does not unload itself. The complete list of what is stored is in the cookie policy.

4. Legal basis and purpose

Consent, for measurement and advertising. Legitimate interest in the security and operation of the site, for the hosting provider's technical logs (Cloudflare). Form data is used only to provide the service you ask for with it: drafting your document, reviewing your draft, finding you a lawyer, or checking your error report. It is not used for advertising and it is not sold.

5. Third parties

Cloudflare (hosting, delivery network and storage of form data). Culqi, which processes payments and receives the email you give for the receipt: we never see or store your card details, and we do not keep that email. Google, in three cases: if advertising is enabled, Google AdSense; in the draft review, the text you paste is sent to Google's Gemini API for the automated review; and in the document assistant used in English, the descriptions you write are sent to the Gemini API to be translated into Spanish, because every document that is filed is in Spanish. Not sent: the fields that ask for a name, an ID number, an address or a place, an amount, a date or a flight number, and any description that looks like it contains a personal identifier (an ID or phone number, an email, an amount, a date, an address, or a name after a title such as “Mr” or “Ms”): you write those in Spanish yourself. That check looks for those patterns in the text and does not recognise every name; if you do not want a name to reach Google, do not write it in a description. You check every field before you file the document. In all cases Google handles that data under its own terms. The document assistant used in Spanish and the lawyer contact form do not send your data to Google. We do not sell data.

The site's typefaces are served from this same domain. No request is made to Google Fonts, so loading a page does not send your IP address to Google unless and until you accept advertising.

6. Your rights

You may exercise the rights of access, rectification, cancellation and objection (ARCO rights), and the others provided by Ley 29733, by writing to privacidad@misderechos.pe. An email is enough: we require no form of our own and no visit in person.

Article 69 of Decreto Supremo 016-2024-JUS sets these response times, counted from the day after the request is filed:

RightTime limit
Information8 days
Access20 days
Rectification, cancellation and objection10 days

Except for the right to information, these may be extended once, by no more than the same period again (article 71.1). If we need that extension we will tell you why before the original period runs out.

If you are not satisfied, you may go to the National Personal Data Protection Authority at the Ministry of Justice.

7. Retention

Technical logs are kept as long as service security requires. Emails, for as long as the conversation that originated them. What you type into the forms is deleted automatically, without anyone having to do it:

  • Document assistant, draft review or a letter-pack order, if you do not pay: deleted after 2 hours.
  • Document assistant or draft review, if you pay (or the document is free), with the download link: deleted 24 hours later.
  • Paid letter-pack order (pack, price, language and code): deleted 24 hours after payment. The code and the uses it has left stop working 180 days after payment; they hold no personal data.
  • Result of a draft review (not the text): deleted after 30 days.
  • Spanish translation of your descriptions, if you use the document assistant in English: deleted after 2 hours.
  • Daily per-connection (IP address) counter for the draft review, the English assistant's translation and the corrections form: deleted after 26 hours.
  • Per-connection counter (IP address, or the /64 block for IPv6) for clicks on the document and tool links on our pages, for notices that a tool gave a result and for failed discount-code attempts: held in memory only, never written to disk, and dropped when the hour ends. It exists only to limit abuse; the weekly totals of clicks per page and of results per tool contain no data about you.
  • Lawyer contact: deleted after 6 months.
  • Corrections-form report: deleted after 90 days.

You can ask us to delete any of this sooner by writing to privacidad@misderechos.pe. We do not keep the receipt email: Culqi receives it and keeps its record of the payment under its own obligations.

8. Minors

This site is not directed at minors. Its pages are written for an adult acting on their own legal situation, and where the subject involves a minor — school charges, adolescent labour — the page addresses the parent or guardian, not the child.

The web is public, though, and anyone can open it. Ley 29733 and Decreto Supremo 016-2024-JUS require a parent's consent to process the data of anyone under fourteen. We have no way to verify a reader's age, and we do not want to build one: asking your date of birth in order to collect less data would be collecting one more. What we do instead is keep the minimum — only what someone types into a form, and only for the periods in point 7 — and load no advertising until someone expressly accepts it.

If you are a parent or guardian and believe this site holds data about a minor in your care, write to privacidad@misderechos.pe and we will deal with it inside the time limits in point 6.

9. International transfers

Cloudflare and Google are companies with operations outside Peru, so what you send through the site may be processed on servers located outside the country. Specifically: Cloudflare hosts the site and stores what you type into forms for the periods in point 7; Google receives data only if you accept advertising (AdSense), use the draft review, which sends it the text you paste, or use the document assistant in English, which sends it your descriptions to translate. Each provider handles that data under its own data protection terms.

Reading the pages sends no data about you to our servers (if you click a link to a document or a tool, only that click is added to a weekly total per page), and using the calculators sends nothing you type. If you do not want a piece of data to leave Peru, do not type it into a form.

10. Automated decisions

The draft review uses an artificial intelligence model from Google (Gemini) to produce observations on the text you paste. The document assistant used in English uses the same model only to translate your descriptions into Spanish, except any that look like they contain a personal identifier (point 5); you read and correct every field before you pay or download. Neither makes a decision with legal effect on you or classifies you. The document assistant used in Spanish, the calculators and the fine finder use no artificial intelligence.

We do not build profiles of the people who use the site. If you accept advertising, Google may personalise the ads you see, under its own terms; you can withdraw that consent at any time (point 3).

11. Security measures

The best measure is to keep little, for a short time:

  • There are no user accounts or passwords to leak.
  • Your card details are received by Culqi; they do not pass through our servers and we do not store them.
  • What you type into forms is deleted automatically within the periods in point 7; it does not pile up.
  • Cases sent for a lawyer and error reports can only be read with an access key held by the site editor.

No system is infallible. If you think something went wrong with your data, write to privacidad@misderechos.pe.

12. Changes

If the site begins processing new data (a newsletter, for instance), this policy will be updated first.
