How do I complain to Peru's Ombudsman, and what can it actually do?
Anyone — Peruvian or foreign — can file a complaint with the Defensoría del Pueblo for free, without a lawyer and without formalities, against any public body or public service. It investigates, demands information and issues recommendations the body must answer in writing within 30 days; it does not fine, does not overturn decisions and is not a court.

Ombudsman (Defensoría del Pueblo)
Checked 1 Oct 2026Next review 12 Dec 2026
What it is for
Ley 26520, article 1, gives the Defensoría del Pueblo two jobs: to defend the constitutional and fundamental rights of the person and the community, and to supervise how the public administration performs its duties and how public services are delivered.
That defines who you can complain about: a municipality, a public hospital, a state school, the police, Reniec, Migraciones, Sunat, a company providing a public service. It is not the channel against a shop, a private employer or a neighbour.
Who can complain
Article 10: «cualquier persona natural o jurídica, en forma individual o colectiva, sin restricción alguna». Your nationality, your age, your migration status and whether you are at liberty do not matter. The only exclusion is article 12: no administrative authority may file a complaint with the Defensor. It is a mechanism for the citizen against the State, not between State offices.
How to send it
Article 19 asks for a signed written statement with your name, your address and a description of the facts, and says it is subject to «ningún otro requisito de carácter formal o económico». No fee. No lawyer. It can be done online. As an exception a verbal complaint is admitted and recorded in a written act.
Article 20 says when a complaint may be rejected: anonymous, in bad faith or without grounds, or when the matter is pending a judicial decision. Even then the Defensoría may investigate the general problem. A decision not to admit cannot be appealed.
What the Defensoría does with your complaint
It investigates. Article 16 obliges authorities to give it the information it requests and to allow inspections, including unannounced ones. With what it finds, article 26 lets it address to officials warnings, recommendations, reminders of their legal duties and suggestions. The body is obliged to answer in writing within a non-extendable 30 days. If it takes no measures, the Defensoría can take the matter to the sector minister or the head of the entity, and to the Contraloría.
What it cannot do
This is what disappoints people most, so know it beforehand:
- It does not sanction. It does not fine the official or the entity.
- It does not annul or change decisions. It cannot revoke the resolution that harms you.
- It is not a court. It does not issue judgments or order payments.
- It does not replace litigation. If the matter is in court, it may reject the complaint.
Its strength is different: it forces the body to inform and to answer in writing, it leaves an official record of the problem, and it escalates when ignored. For a migrant facing a counter that never answers, that is more than it sounds.
When to use it and when not to
| Problem | Channel |
|---|---|
| A public body does not answer, mistreats you or demands something the law does not require | Defensoría del Pueblo |
| A private company overcharges you or ignores your complaint | Libro de reclamaciones and Indecopi |
| Your employer breaks labour rules | Sunafil |
| There is already a lawsuit on the same matter | The lawsuit; the Defensoría may reject the complaint |
| An official asks you for money | Criminal report (Ministerio Público), and the Defensoría as well |
Is your complaint about a security camera?
If your complaint involves surveillance cameras and the use of your image, first review your specific rights in video surveillance: your rights regarding security cameras before going to the Ombudsman.

What people fail to ask in time
And if the problem came from a private company rather than a public body, do you know which door to knock on?
Find out before it matters →What most people believe — and what the law says
The Defensoría is only for Peruvians.
Article 10 says «cualquier persona natural o jurídica, en forma individual o colectiva, sin restricción alguna». Your nationality and your migration status are not a condition.
I need a lawyer and there is a fee.
Article 19 says the complaint is subject to no formal or economic requirement. A written statement with your details and the facts is enough. It can be done online.
The Defensoría will fine the official or cancel what they did.
It has no such power. It investigates, demands information and issues warnings, recommendations and reminders (article 26). The body must answer in writing within 30 days. If it does not correct course, the Defensoría can escalate to the minister or the Contraloría. It is institutional pressure, not a judgment.
I can complain about my boss, a shop or my neighbour.
The Defensoría supervises the public administration and public services (articles 1 and 9). Against a private company the route is the libro de reclamaciones, Indecopi or Sunafil. The exception is a private company providing a public service.
If I already have a court case on the matter, the Defensoría will speed it up.
Article 20 lets it reject a complaint when the matter is pending a judicial decision. The Defensoría is not another stage of the lawsuit.
Frequently asked questions
How long does the body have to respond to a Defensoría recommendation?
A non-extendable 30 days to answer in writing (Article 26). If the body takes no action, the Defensoría can escalate the matter to the sector minister, the head of the entity, or the Contraloría.
Can the Defensoría inspect an entity without giving prior notice?
Yes. Article 16 obliges authorities to give it the information it requests and to allow inspections, including unannounced ones.
What happens if my complaint is rejected for being anonymous or because the matter is already in court?
Article 20 allows rejection in those cases, but the Defensoría may still investigate the underlying general problem. A decision not to admit the complaint cannot be appealed.
Can a public official file a complaint with the Defensoría del Pueblo?
No. Article 12 says no administrative authority may file a complaint with the Defensor: it is a mechanism for the citizen against the State, not between State offices.
