How do you change your immigration status without leaving Peru?
You apply to Migraciones from inside Peru while your status is regular. If you file before your current period expires, that period is suspended until they decide; to travel meanwhile you need an authorization to stay outside the country.

What it is and who can apply
A change of calidad migratoria (immigration status) is the procedure to move from the status you hold to a different one: tourist to worker, worker to family resident, student to worker, and so on. The regulation of Decreto Legislativo 1350 (Decreto Supremo 007-2017-IN) sets three general rules in article 65:
- You apply to the authority in charge of the status you want. For worker, family resident or student status, that authority is Migraciones.
- You must be in Peru and in regular immigration status.
- It can only be requested inside the country. You do not need to leave and re-enter.
The regulation does not exclude tourists. The worker resident page does not require prior residence either. But the gob.pe guidance page (from 2021) speaks of changes for foreigners “who have residence”, and the family resident page opens with “if you are a resident foreigner”. If you are a tourist, confirm with Migraciones before you pay.
Keep in mind that tourist status, under the law, does not allow work or paid activities (article 29.1.h of Decreto Legislativo 1350). Which status you need to work is covered in work visa or immigration status and working in Peru as a foreigner.
What the most common pages ask for
The three pages we read, updated on 22 April 2024, charge the same fee: S/ 161.40 with code 07568. The worker and family resident pages give up to 30 business days to email you the result.
- Worker resident. Form, passport, Interpol certificate no older than 6 months (minors do not file it), criminal records for the 5 years before you arrived, a statement from the company’s legal representative and, if you are an employee, a contract approved by the labor authority for one year or more. If the contract is shorter than a year or has a probation period, the page points you to temporary worker status instead.
- Family resident. Form, passport and, depending on the case, the marriage certificate with the validity the page indicates. You must be in the country when you file and have no criminal record in your country of origin. The details of a link with a Peruvian are in residency through marriage.
- Student (formación). For studies or internships at recognized institutions. The page repeats that you can only request it from inside the country.
The Interpol certificate is explained in Interpol record check. Indecopi declared it illegal to require it for changing to rentista and permanent status (Resolución 0254-2023/SEL-INDECOPI). Migraciones’ nationality pages report that a court injunction suspended part of that ruling as regards the Interpol certificate; we did not read the rentista or permanent pages to see how they apply it today.
What happens to your period while you wait
This is the rule that reassures most and that fewest people know. Article 60 of the regulation says that if you file the change before your period of stay or residence expires, that period is suspended automatically. The suspension keeps the benefits of your current status until the business day after you learn the decision.
The same article has one exception: the suspension does not extend to the special permit to travel. Travel needs its own authorization.
If you file after your period has expired, this rule does not cover you. That situation is covered in overstay.
Can I travel while it is being processed?
Yes, with an authorization to stay outside the country (the Agencia Digital calls it permiso especial de viaje). The regulation (article 67.2.1) and the gob.pe page (10 February 2025) say:
- It is for anyone with a pending change or extension of immigration status.
- It lets you stay abroad for up to 30 calendar days, and you need one authorization per trip.
- You request it before leaving, stating your travel date, using the same document you entered Peru with.
- It is free.
- If you exceed the 30 days, the page says you lose the pending application.
On the lead time, the sources do not match. The page asks you to apply 48 hours before the trip. The same page says processing takes 7 business days, and the regulation sets that same review period, with positive administrative silence (approval if they do not answer in time). If you can, apply more than 7 business days ahead.
Article 44.2 of the regulation is sometimes cited for this rule. We checked: article 44.2 exists, but it is about the carné de extranjería. It says that if you must leave the country during that procedure, you should request your permit to stay outside the country. The general rule for a change or extension is article 67.2.1. The carné itself is explained in carné de extranjería.
If it is approved or denied
If it is approved, the next step is the carné de extranjería, explained above. Each status has its own period of stay; how to renew it is in extending your residency. After three years as a legal resident, the law allows you to apply for permanent status.
If it is denied, Migraciones issues an exit order. You have 15 calendar days from when you learn of it to leave Peru; in exceptional situations Migraciones can give you 15 more days. If you do not leave, it opens a sanctioning procedure (article 61 of the regulation).

The travel stages apply only if you leave Peru while the change is pending. The last one applies only if it is denied.

To switch from tourist to worker I have to leave Peru and come back with a visa.
The regulation says the opposite: a change of immigration status can only be requested inside the country, and you must be in regular status (article 65.2 and 65.3).
If I file the change, my tourist period keeps running and I fall into overstay.
If you file before your period expires, it is suspended automatically until the business day after you learn the decision (article 60 of the regulation).
While I wait for the answer I can start working.
The suspension keeps the benefits of the status you already have (article 60.2). If that status is tourist, the law says it does not allow work (article 29.1.h of Decreto Legislativo 1350). This follows from the two articles read together; it is not written in a single sentence.
With the application pending I can leave and come back whenever I like.
You need an authorization to stay outside the country for each trip, requested before you leave, and it covers 30 calendar days. If you stay longer, Migraciones' page says you lose the pending application.

What happens if Migraciones denies it?

When can I move to permanent status?
The law says permanent status is granted after three years as a legal resident (article 29.2.o of Decreto Legislativo 1350). The regulation lists which residents can opt for it: religious, investor, worker, research, family of a resident, consular, diplomatic, official and family of an official.
Can a representative or my employer do it for me?
According to the pages, not in the most common cases: the worker page says the procedure is personal and does not allow a representative, as does the student page; the family resident page says it is personal.
