Work certificate request letter

We draft your letter demanding your work certificate from the data you give us, citing Supreme Decree No. 001-96-TR. This is not legal advice or representation, and it does not replace a complaint to Sunafil if the employer still refuses to deliver it.

This is not legal advice or representation. A "constancia de trabajo" and a "certificado de trabajo" are not the same thing: the constancia is informal and not required by law; the certificado is. Under the Third Complementary, Transitory and Final Provision of Supreme Decree No. 001-96-TR, your employer should have given it to you within 48 hours of your employment ending. This letter demands it be handed over, with a further deadline. We cannot issue the certificate ourselves — only your employer can — and this does not cover filing a complaint with Sunafil if they still don't comply.
Required so the letter can be delivered (via notary or by hand, with proof of receipt).
For example, "5 business days." The legal 48-hour deadline has already passed; this is a further reasonable window before escalating.

It is a draft that you review and file yourself. It is not legal advice or representation. Delivering it is free and you do not need a lawyer; what you pay for is the drafting.
