Letter demanding payment of labor benefits

We draft your letter demanding unpaid CTS, gratificación, vacation pay, overtime or profit-sharing, citing the rule behind each benefit. This is not legal advice or representation, and it does not replace a Sunafil complaint or a court claim.

This is not legal advice or representation. The letter demands, in writing and with a deadline, that your employer pay the benefits you list, and cites the rule for each one: CTS (deposits in May and November), gratificaciones (July and December), vacation pay, overtime and profit-sharing. For profit-sharing, a written demand is also what starts default interest running under Article 6 of Legislative Decree 892. You enter the amounts yourself: you can work them out for free with our calculators. If they don't pay, the next step is a Sunafil complaint (free) or a labor lawsuit, which this letter does not cover.
Needed to deliver the letter by hand (with proof of receipt) or via a notary.
For example: "S/ 1,250 — May 2026 deposit". Leave empty whatever is not owed. Fill in at least one benefit.
For example: "S/ 2,000 — July 2026 gratificación" or "pro-rated gratificación".
For example: "S/ 900 — pro-rated vacation" or "untaken vacation for 2024-2025".
For example: "S/ 640 — 40 hours between March and June 2026".
For example: "S/ 3,100 — 2025 profit-sharing". If you do not know the amount, write just the year: the letter also asks for the breakdown.
For example, "5 business days."

It is a draft that you review and file yourself. It is not legal advice or representation. Delivering it is free and you do not need a lawyer; what you pay for is the drafting.
