Techo Propio housing bonus in Peru: who is responsible if it is not disbursed?
Fondo MIVIVIENDA pays the bonus, but never to your family: it transfers it to the developer, the bank or the project trust once they post guarantees and documents. If no one requests it within 24 months, your family loses the right, unless the Fondo approves an exception for causes not attributable to anyone.

The bonus is not paid to you
Under Techo Propio’s new-home purchase track (Adquisición de Vivienda Nueva), the Bono Familiar Habitacional (BFH) is administered by Fondo MIVIVIENDA. Ley 27829 puts it this way:
“Facúltase al Fondo Hipotecario de Promoción de la Vivienda (FONDO MIVIVIENDA) […] la administración y otorgamiento del Bono Familiar Habitacional previo proceso de promoción, inscripción, registro, verificación de información y calificación de postulaciones.” (Ley 27829, article 6)
(The Fondo is empowered to administer and grant the bonus, after a process of application, registration, checks and scoring.)
The current operating rules (Reglamento Operativo, Resolución Ministerial 0104-2025-VIVIENDA) say where the money goes:
“El desembolso es la etapa en la cual el FMV transfiere el BFH y, de ser el caso, el Ahorro de los GFB a las cuentas de la ESFS, a la cuenta del Promotor o, a la cuenta administradora del Proyecto en el marco del Fideicomiso o, a la cuenta que la IFI mantiene en el BCRP […]” (article 21.1)
(Disbursement is when the Fondo transfers the bonus, and your savings if applicable, to the bank’s account, the developer’s account, the project trust’s account, or the account a financial institution holds at the Central Bank.)
In plain terms: the bonus, plus your savings if you deposited them in the Fondo’s account, goes to the bank backing the project, the developer (promotor), the project trust or a financial institution. Never to your family.
Who requests disbursement, and what they must file
Your family does not request the disbursement. Someone else does:
“Para efectos del desembolso, el Promotor, la ESFS o la IFI, según corresponda, presenta al FMV las garantías y los documentos señalados en el Anexo 5 […]. 21.3 Asimismo, los GF deben tener la condición de GFB, es decir se le debe haber asignado el BFH.” (articles 21.2 and 21.3)
(The developer, the bank or the financial institution files the guarantees and the Annex 5 documents with the Fondo. The family must be a beneficiary family group, meaning the bonus has been assigned.)
So there are two conditions:
- Your family must already be a “beneficiary family group”: the bonus must have been assigned.
- The developer, the bank or the financial institution must post guarantees and file the Annex 5 documents. We do not list those documents because we did not read the annex.
Once the Fondo validates the guarantees and documents, it has up to 8 business days to pay (article 21.1). If you are buying with a top-up loan, the bonus is transferred up to 3 business days after that loan is paid out (article 21.5). If the loan does not go through, neither does the bonus.
The clock running against your family: 24 months
This is the rule almost nobody knows:
“La condición de GFB tiene una vigencia de veinticuatro (24) meses contados a partir de la fecha en que el GF obtiene el estado de Beneficiario. […] Transcurrido dicho plazo sin que el Promotor, ESFS o IFI haya solicitado el desembolso del BFH, pierde la condición de GFB y por ende el derecho al referido desembolso […]” (article 20.2)
(Beneficiary status lasts 24 months. If the developer, bank or financial institution has not requested disbursement by then, the family loses the status and the right to the disbursement.)
Your family bears the consequence, but the missing step belongs to the developer, the bank or the financial institution. That is why you need to know whether they have filed the request.
There is a way out:
“Cualquier excepción al plazo de vigencia de la condición de GFB y del ejercicio de su derecho al desembolso del BFH por causas no atribuibles al Promotor, a la ESFS o, a la IFI o, al GFB, es evaluada y, de ser el caso, aprobada por el FMV.” (article 20.3)
(Any exception to the 24-month period for causes not attributable to the developer, the bank, the financial institution or the family is assessed and, if appropriate, approved by the Fondo.)
The Fondo decides. Note the wording: causes not attributable to any of them, your family included. The rules do not say what happens when the delay is the developer’s fault alone. Against the developer, you also have your rights as a consumer.
The guarantees that protect your bonus and savings
The rules do not rely on the developer’s word. They require two kinds of guarantee in the Fondo’s favour.
Before disbursement: a bid bond (carta fianza de seriedad de oferta). It covers the developer’s steps up to the disbursement request, in projects with a bank construction credit line and in projects with no bank backing:
”[…] Carta Fianza de Seriedad de Oferta, la cual es irrevocable, incondicional y de realización automática a favor del FMV y debe contar con una vigencia de trescientos sesenta (360) días calendario […]; por un monto equivalente al 3% del valor de la VIS registrada. […] La ejecución de la Carta Fianza de Seriedad de Oferta genera la devolución del Ahorro mínimo al GFE.” (article 22.1)
(An irrevocable bond payable on demand to the Fondo, valid for 360 calendar days, for 3% of the registered home’s value. If it is called, the family’s minimum savings are returned.)
For construction and delivery. These guarantees secure “la recuperación del BFH y del Ahorro” (recovery of the bonus and the savings). They can be a bank-issued bond, a joint guarantee, a resource-guarantee agreement, a trust, or a funds-channelling agreement (article 22.2). The first three must be issued “por el 105% del valor del BFH y del Ahorro del GFB” (for 105% of the bonus and the family’s savings; article 22.3).
What about construction progress?
The main text of the rules does not tie disbursement to a percentage of progress. It ties it to guarantees and documents. What does depend on the works is the reduction of the guarantee. Only when a technical report certifies that your home is “terminada al 100%” (100% finished) does the guarantee for that home drop “del 105% al 10%” (from 105% to 10%; article 23.3). The Fondo can also ask for progress reports and make unannounced checks (articles 14.2 and 27.2).
One more rule worth knowing: the delivery period in your contract “se contabiliza a partir del desembolso del BFH” (runs from the bonus disbursement; article 14.1.f). And the rules are clear on who builds: “El Promotor es el responsable de la ejecución del Proyecto y de la construcción de las VIS conforme a éste” (the developer is responsible for the project and for building the homes; article 33.1).
If the developer fails
The Fondo calls the guarantees when they expire without renewal, when the project is not built and delivered as committed, or when false information is filed (article 25.1). If it collects:
”[…] el FMV devuelve el BFH de acuerdo con las condiciones pactadas en los convenios de ejecución suscritos con el MVCS y el Ahorro al GFB, de corresponder.” (article 25.3)
(The Fondo returns the bonus under its agreements with the Housing Ministry, and returns the savings to the family where applicable.)
Then there are two paths:
- The developer files a plan to finish the works within 60 calendar days of the guarantee being called, and the Fondo approves it. The developer can then request disbursement again (article 25.6).
- There is no plan, the Fondo rejects it, or your family terminates the contract. Your family regains eligible status for two years, provided it owns no property (article 25.7). That lets you apply in another project.
Article 32.1 backs this up: when the developer defaults, the Fondo “restituye la condición de elegible a los beneficiarios del BFH” (restores eligible status to the beneficiaries), as long as no family member owns a property.
If the Fondo cannot call a guarantee straight away, it starts administrative and court proceedings to recover the bonus and the savings, plus “un 20% adicional del monto desembolsado” (an extra 20% of the amount paid out; article 31.4). That claim is the Fondo’s against the developer, not against your family.
If your family wants out before delivery
You can give up the bonus “hasta antes de la entrega de la VIS” (up to delivery of the home) by filing the terminated purchase contract with the Fondo (article 29.1). If the bonus had already been paid out, the Fondo demands it back from the developer, trust, bank or financial institution, and they must “devolver al beneficiario los recursos del Ahorro” (return the savings to the beneficiary) and prove it to the Fondo (articles 31.1 and 31.2).

Where to complain
Under the rules, the decisions that affect you are taken by Fondo MIVIVIENDA: it assesses exceptions to the 24-month period, calls the guarantees, approves or rejects the completion plan and restores eligibility. Your request about the bonus goes to the Fondo. The rules do not set a specific complaint procedure for families before the Fondo.

How to file
- Confirm your family is a beneficiary, and since whenBeneficiary status lasts 24 months from the date it is obtained. The rules say Fondo MIVIVIENDA publishes that date on its website. Write it down.
- Ask the developer in writing whether it has requested disbursementThe developer, the bank or the financial institution requests disbursement, not you. Ask them to confirm in writing the date of the request and which guarantee backs your home.
- If there is a loan, ask the bank whether it has paid it outWith a top-up loan, the bonus is transferred after that loan is disbursed. If the loan does not go through, neither does the bonus.
- If the deadline is near and the delay is not yours, write to Fondo MIVIVIENDAThe rules give the Fondo the power to assess and approve exceptions to the 24-month period for causes not attributable to the parties. Explain the situation and attach your contract and the developer's answer.

None of this is law in force yet. What this page explains is what applies today; this is what could change it.

Resolución Ministerial N.° 270-2026-VIVIENDA (draft new Operating Regulation for the Bono Familiar Habitacional, new-home purchase track)
- Where it stands
- Draft published for comment in the extraordinary edition of El Peruano on 20 July 2026, with 15 calendar days for comments. As of 30 September 2026 we found no resolution in El Peruano approving a final version.
- What it would change
- It would replace the rules that govern buying a new home with Techo Propio today (Resolución Ministerial 0104-2025-VIVIENDA). According to the resolution itself, the three main changes would be: the complementary financing could also be a non-mortgage housing loan from a financial institution; projects financed through a securitization trust with Fondo MIVIVIENDA's participation would be included; and an exceptional value of «el 25% al valor del BFH» would apply when the head of household is a student aged 20 to 28 in the final years of study. We do not know whether it changes the 24-month deadline to request disbursement or the guarantees, because we did not read the full draft.
- How it would take effect
- Only if the Ministry of Housing approves a final version through a new ministerial resolution published in El Peruano. That resolution will set its start date. A draft binds no one.

Fondo MIVIVIENDA deposits the bonus with me and I pay the developer.
No. The rules say the Fondo transfers the bonus to the account of the bank, the developer, the project trust or the financial institution, as the case may be (article 21.1). Your family never receives it in cash.
Once I am a beneficiary, the bonus is mine for good.
Beneficiary status lasts 24 months. If the developer, the bank or the financial institution does not request disbursement in that time, your family loses the right to it, unless the Fondo approves an exception for causes not attributable to any of the parties (articles 20.2 and 20.3).
If the builder goes bust, the bonus and my savings are gone.
The rules require construction and delivery guarantees for 105% of the bonus and the savings. If the Fondo calls them, it returns the savings to your family where applicable, and can restore your eligibility (articles 22, 25 and 32).
The bonus is released to the developer as the works progress.
Under the rules, disbursement depends on the developer posting guarantees and filing the Annex 5 documents. What depends on the home being 100% finished is the reduction or release of those guarantees (article 23).
Frequently asked questions
Who pays me the Techo Propio bonus?
Fondo MIVIVIENDA, which Ley 27829 empowers to administer and grant the bonus. But it does not pay you: it transfers the money to the account of the bank, the developer, the project trust or the financial institution, as the case may be.
Who has to request the disbursement: me or the developer?
Under article 21.2 of the rules, the developer, the bank or the financial institution files the guarantees and the Annex 5 documents with the Fondo. Your family must already have beneficiary status, meaning the bonus has been assigned.
How long does the Fondo take to pay?
Up to 8 business days after it validates the guarantees and documents. If there is a top-up loan, the bonus is transferred up to 3 business days after that loan is disbursed (articles 21.1 and 21.5).
What if two years pass and no one requested the disbursement?
Beneficiary status lasts 24 months. If the developer, the bank or the financial institution did not request disbursement in that time, the family loses the status and the right to disbursement. The Fondo can approve an exception when the delay comes from causes not attributable to the developer, the bank, the financial institution or the family.
If the works stop, do I get my savings back?
If the Fondo calls the guarantees, it returns the savings to your family where applicable (article 25.3). If the contract is terminated before delivery, the developer, bank or financial institution must return your savings and prove it to the Fondo (article 31.2).
Can I apply again if the project fails?
The rules let you regain eligible status if the developer defaults, as long as no one in the family group owns a property (article 32.1). In the case in article 25.7, that restored status lasts two years.
