Building declaration, internal regulations and unit subdivision in Peru: what order do they go in?

Short answer

First the municipality issues the conformidad de obra y declaratoria de edificación. Then the declaratoria de fábrica is registered at Sunarp. Only after that is the reglamento interno registered, and that registration splits each unit into its own registry file; the parent file keeps the common areas.

The order, in one line

Building licence → works → conformidad de obra y declaratoria de edificación (municipality) → registration of the declaratoria de fábrica (Sunarp) → registration of the reglamento interno, which brings with it the independización of each unit (Sunarp).

Step 1: works sign-off and building declaration (municipality)

When the works end, the builder describes what was built and files it with the municipality that issued the licence. Article 28 of Ley 29090 defines it:

«Una vez concluidas las obras de edificación, quien las realice efectúa una descripción de las condiciones técnicas y características de la obra ejecutada, la cual se denomina declaratoria de edificación.»

(Once the building works are finished, whoever carried them out describes the technical conditions and features of the completed works; this is called the building declaration.)

The procedure depends on your licence modality:

  • Modality A: the official stamps and signs the documents on receipt. Article 28: «Este acto constituye la Conformidad de Obra y Declaratoria de Edificación y autoriza su inscripción registral» (this act is the sign-off and authorises registration).
  • Modalities B, C and D: the urban-control office checks the plans, inspects the works and records the sign-off on the Formulario Único, within «un plazo no mayor a quince (15) días calendario» (no more than fifteen calendar days). If that passes with no sign-off, «se aplica el silencio administrativo positivo» (it is deemed approved).

There is a variant for financed projects: article 28-A allows an early sign-off at shell stage (casco no habitable), only in modalities B, C and D, for housing, offices and retail.

Step 2: register the declaratoria de fábrica (Sunarp)

The municipal sign-off does not register anything by itself. It has to go to the property registry. Article 78 of Sunarp’s Reglamento de Inscripciones del Registro de Predios says the declaratoria de fábrica is registered with the Formulario Único de Edificaciones (FUE) under Ley 29090, or with a public deed that includes or attaches it.

The municipal law says declaratoria de edificación; the registry rules say declaratoria de fábrica. It is the same step seen from each office.

Step 3: the internal regulations, always after the building declaration

This is where most files get stuck. Article 83 is short:

«Para la inscripción del Reglamento Interno deberá inscribirse previamente la respectiva declaratoria de fábrica, salvo disposición expresa en contrario.»

(To register the internal regulations, the building declaration must be registered first, unless a specific rule says otherwise.)

If the building declaration is not registered, the internal regulations will not go through.

When it applies. The regulation of Ley 27157 (D.S. 035-2006-VIVIENDA, article 125) says the exclusive-and-common ownership regime is «obligatoria cuando las secciones que la conforman pertenezcan a dos o más propietarios y optativa cuando pertenezcan a uno solo» (mandatory with two or more owners, optional with one).

Which regime. When you apply to register the reglamento interno you choose between exclusive-and-common ownership and independización y copropiedad (article 127 of D.S. 035-2006-VIVIENDA). But if units sit one above another, article 84 of the registry rules decides for you:

«el régimen de propiedad exclusiva y propiedad común es obligatorio en todos los casos en que existan unidades inmobiliarias superpuestas en el plano vertical.»

(Exclusive-and-common ownership is mandatory wherever units are stacked vertically.)

What it must contain. At least the parent property and the list of units «señalando sus áreas, numeración y el uso» (with area, number and use of each), and the common areas (article 153(a)).

How it is signed. A public deed, or a private document with signatures certified by a notary, granted by the owners or by the association’s president. If the president signs, the minutes approving it «con el voto favorable de más del 50% de los propietarios» (by more than 50% of the owners) go with it (article 86).

Step 4: the split comes with the internal regulations

Independización means opening a separate registry file for each unit (article 58). In a building, it is not a separate step at the end. Article 88 ties it to the internal regulations:

«La inscripción del Reglamento Interno conlleva la independización simultánea de las unidades inmobiliarias de propiedad exclusiva.»

(Registering the internal regulations entails splitting off the exclusive units at the same time.)

So your filing must include, besides the internal regulations, what article 63 requires:

Result: each unit gets its own file, «relacionándolas con la partida matriz» (linked to the parent file, article 63). The parent file keeps «sólo» (only) the common areas, the internal regulations, the owners’ association, its president and charges on the whole building (article 88).

If the building is still going up

A developer selling off-plan does not have to wait until the end to set up the registry. Articles 73 and 77 allow provisional entries for the pre-declaration (predeclaratoria de fábrica), the draft internal regulations (prereglamento interno) and the pre-subdivisions (preindependizaciones). When the works finish as noted, the building documents are filed and those entries become final. Article 77 only covers the case where the building was built as pre-declared.

What about Decreto Legislativo 1595?

D.Leg. 1595 (December 2023) changes the route for regularising buildings. Its repeal clause names «el Título I de la Ley Nº 27157», Ley 27333 and article 30 of Ley 29090. It does not name the part of Ley 27157 on exclusive and common ownership, which governs internal regulations and owners’ associations. Its own text also says it «entra en vigencia a los ciento veinte días hábiles siguientes a la publicación de su Reglamento» (comes into force one hundred and twenty business days after its regulation is published). Our reading: for a building with a licence and a works sign-off, the order on this page does not depend on that decree.

Mistakes that cost months

  • Asking for the split without a registered building declaration. Article 83 blocks it.
  • Plans that do not match. The sign-off (article 28) checks that the as-built plans match the licence. Changes show up there, before Sunarp.
  • Internal regulations without the full list of units. Article 153 requires area, number and use for each.
  • Uncertified signatures. The memoria descriptiva, plan and internal regulations need certified signatures (articles 63 and 86).

A new law that is not in force yet: Decreto Legislativo 1568

Decreto Legislativo 1568 (2023) creates a new horizontal-property regime, but it is not in force yet: as of 30 September 2026 its regulation has not been published. That is why this page applies Ley 27157 and its regulation. We explain what would change in «Possible changes ahead» below.

How to file

  1. Ask for the works sign-off and building declarationWhen the works end, file the *declaratoria de edificación* with its plans and the Formulario Único at the municipality that issued the licence (article 28 of Ley 29090). For modalities B, C and D the municipality has no more than fifteen calendar days; if it does not answer, positive administrative silence applies.
  2. Register the declaratoria de fábrica at SunarpUse the approved FUE, or a public deed that includes or attaches it, plus the plans required by article 78 of the registry rules. This comes before the internal regulations (article 83).
  3. Draft the reglamento internoIt must list the parent property, each unit with its area, number and use, and the common areas (article 153 of D.S. 035-2006-VIVIENDA). You choose the regime when registering it; if units are stacked, exclusive-and-common ownership is mandatory (article 84).
  4. Gather the subdivision documentsA *memoria descriptiva* with certified signature and a subdivision plan signed by a professional with the signature certified by a notary (article 63). The internal regulations go by public deed or a private document with certified signatures (article 86).
  5. File the internal regulations with the subdivision and check the filesRegistering them splits off the units at the same time (article 88). Then request a *copia literal* of each new file and of the parent file to check areas, numbering and common areas.

Possible changes ahead

None of this is law in force yet. What this page explains is what applies today; this is what could change it.

Published, not yet in force

Decreto Legislativo N.° 1568, Decreto Legislativo del Régimen de la Propiedad Horizontal

Where it stands
Published in El Peruano on 28 May 2023, but not in force yet. The only step so far is the draft regulation the Ministry of Housing published for comment with Resolución Ministerial 242-2024-VIVIENDA (El Peruano, 16 July 2024). As of 30 September 2026 we found no supreme decree in El Peruano approving that regulation.
What it would change
The decree would let an owner pre-register, in one act, the planned building, a draft internal regulation and the pre-split of units («prehorizontalidad», article 7). If a building has no internal regulations, owners of more than 50% of the units with title could grant them in one record covering the building declaration, the internal regulations and the unit split (articles 11 and 32.2).
How it would take effect
First, the Ministry of Housing must approve the regulation by supreme decree. Then the period set by the decree itself runs: «El presente Decreto Legislativo entra en vigencia a los ciento ochenta días calendario siguientes a la publicación de su Reglamento» (it takes effect 180 calendar days after its regulation is published). On that day Title III of Ley 27157, which governs private and common property in buildings today, is repealed.
When
No date. It takes effect 180 calendar days after a regulation that does not exist yet is published. The decree gave the government 180 calendar days from its publication to approve that regulation; by our count, that deadline passed on 24 November 2023.

What most people believe — and what the law says

The belief

Once I have the building licence, I can get a separate registry file for each apartment.

The law

No. The licence lets you build. After the works you need the *conformidad de obra y declaratoria de edificación* (article 28 of Ley 29090), then the registered *declaratoria de fábrica*, and only then the *reglamento interno*, whose registration splits off the units (articles 83 and 88 of Sunarp's Reglamento de Inscripciones del Registro de Predios).

You register the internal regulations first and sort out the building declaration later.

It is the other way round. Article 83 says that to register the *reglamento interno* «deberá inscribirse previamente la respectiva declaratoria de fábrica, salvo disposición expresa en contrario» (the building declaration must be registered first, unless a rule says otherwise).

Where units are stacked «superpuestas en el plano vertical», the exclusive-and-common ownership regime is mandatory (article 84). The *independización y copropiedad* option is for the other cases.

Its repeal clause names Title I of Ley 27157 (regularising buildings), not the part on exclusive and common ownership. And it comes into force one hundred and twenty business days after its regulation is published.

Frequently asked questions

Are declaratoria de fábrica and declaratoria de edificación the same thing?

They are the same step under two names. Ley 29090 calls the description of the finished works you file with the municipality the «declaratoria de edificación». Sunarp's registry rules call it «declaratoria de fábrica» when it is registered, and article 78 says it is registered with the Formulario Único de Edificaciones (FUE) under Ley 29090, or with a public deed that includes or attaches it.

Can I file the building declaration and the internal regulations together?

Article 83 requires the declaration to be registered «previamente» (beforehand). Article 86 does mention a *reglamento interno* «presentado adjunto al Formulario Único de Edificaciones (FUE)», with notarised signatures. How a registrar treats that in your case we did not review: ask at Sunarp or your notary before filing.

Who signs the internal regulations?

Under article 86, the owners, or the president of the owners' association with a certified copy of the minutes approving it «con el voto favorable de más del 50% de los propietarios». It is registered by public deed or by a private document with signatures certified by a notary.

What does Sunarp need to split off the units?

Article 63 asks for the *reglamento interno* in the form set by article 86; a *memoria descriptiva* signed by the owner (signature certified) giving the area, boundaries and measurements of each unit and of the common areas; and a subdivision plan signed by a qualified professional, with the signature certified by a notary.

What stays in the parent registry file after the split?

Only the common areas. Under article 88, that file then holds the *reglamento interno* and its changes, the owners' association, its president and any charges on the whole building. Each unit gets its own file, linked to the parent (article 63).

The building is still under construction. Can anything be done at Sunarp yet?

Yes. Articles 73 and 77 allow a provisional entry (*anotación preventiva*) of the pre-declaration, the draft internal regulations and the pre-subdivisions. When the works are finished as noted, the building documents are filed and those entries become final.

I built without a licence. Does this order apply to me?
