T-Registro and PLAME in Peru: how fast must your employer register you, and what is the infraction if they don't?
Your employer must register you in the T-Registro within the same day you start work, whatever your contract, and deregister you within the first business day after your job ends. Not registering you is a very serious infraction, counted per worker; registering you late is a serious one.

What the electronic payroll is: T-Registro and PLAME
Being “on the payroll” (en planilla) in Peru means being in the Planilla Electrónica that SUNAT runs. It has two parts. Article 1(h) of D.S. 018-2007-TR, as worded by D.S. 015-2010-TR, says:
“La Planilla Electrónica se encuentra conformada por la información del Registro de Información Laboral (T-REGISTRO) y la Planilla Mensual de Pagos (PLAME) que se elabora obligatoriamente a partir de la información consignada en dicho Registro.”
(The electronic payroll is made up of the Labor Information Register, T-Registro, and the Monthly Payroll, PLAME, which must be prepared from the information in that register.)
- T-Registro: where your employer registers you (alta), updates your data and deregisters you (baja).
- PLAME: the monthly payroll. It is built from what is in the T-Registro. SUNAT sets the filing schedule by resolution (article 5).
So the PLAME depends on what your employer put in the T-Registro.
Registration: within the day you start
Article 4-A of D.S. 018-2007-TR sets the deadline to register a worker:
“dentro del día en que se produce el ingreso a prestar sus servicios, independientemente de la modalidad de contratación y de los días laborados.”
(Within the day the person starts providing services, whatever the type of contract and the days worked.)
The day you start work is the last day to register you. It does not matter whether your contract is open-ended, fixed-term or part-time, or how few days you work. Your employer may also register you before you start.
Deregistration and data changes
The same article 4-A sets the other deadlines:
“Cualquier modificación o actualización de los datos de la información existente en el T-REGISTRO, deberá ser efectuada por el empleador dentro del plazo de cinco (05) días hábiles de haber ocurrido el evento o de la fecha en que el empleador tuvo conocimiento. La baja de los sujetos registrados deberá ser efectuada dentro del primer día hábil siguiente a la fecha en que se produjo el término de la prestación de servicios […]”
(Any change to the data must be made within five business days of the event or of when the employer learned of it. Deregistration must be done within the first business day after the work ended.)

Your certificate: proof that you were registered
Your employer must also give you a certificate (constancia). Article 4-A says:
“a) Alta en el Registro: el día hábil siguiente del inicio de la prestación de servicios. b) Modificación o actualización de datos: dentro de los quince (15) días calendarios siguientes a la fecha en que se produjo la modificación o actualización. c) Baja en el Registro: solo en aquellos casos que sea solicitado, ésta se deberá entregar dentro de los dos (02) días calendario siguiente de la fecha en que se presentó la solicitud.”
(Registration certificate: the business day after you start. Data change: within fifteen calendar days. Deregistration: only if you ask, within two calendar days of your request.)
The certificate can be on paper or electronic, but the employer must be able to prove you received it. If you never got a registration certificate, ask for one, and check the start date on it.
The infraction: not registering is very serious
The Labor Inspection Regulation (D.S. 019-2006-TR) treats two different kinds of conduct.
Not registering you is a very serious infraction (infracción muy grave). Numeral 25.20 says:
“No registrar trabajadores […] en las planillas de pago o planillas electrónicas a que se refiere el Decreto Supremo Nº 018-2007-TR y sus modificatorias […] en el plazo y con los requisitos previstos, incurriéndose en una infracción por cada trabajador […]”
(Not registering workers in the payroll or electronic payroll under D.S. 018-2007-TR, within the deadline and with the required details, with one infraction for each worker.)
Registering you late or wrongly is a serious infraction (infracción grave). Numeral 24.2 covers, among other things, incomplete data, false data or data that does not match reality, and:
“no efectuar el alta en el Registro, la modificación o actualización de datos, o la baja en el Registro, dentro del plazo correspondiente.”
(Not registering, updating data or deregistering within the applicable deadline.)

How to file
- Ask for your registration certificateYour employer must give you the constancia de alta on the business day after your first day of work (article 4-A). If they do not, ask in writing, by email or message, so there is a record.
- Check the data, especially your start dateIf the certificate has wrong data, ask for a correction. Your employer has five business days to change data in the T-Registro and fifteen calendar days to give you the certificate for the change (article 4-A).
- Keep proof that you work thereContracts, payslips, messages with instructions, photos of your ID badge, attendance records. They help if you later need to show when you started.
- If they do not register you, report it to SunafilNot registering a worker is a very serious infraction (numeral 25.20). You can file the complaint online.

During a trial period, they do not have to put you on the payroll.
You must be registered in the T-Registro within the day you start, "independientemente de la modalidad de contratación y de los días laborados" (whatever the type of contract and the days worked), under article 4-A of D.S. 018-2007-TR. The rule mentions no exception for a trial period.
If you only work a few days, you do not need to be registered.
The rule says the opposite: the registration deadline applies regardless of the days worked (article 4-A).
If they fail to register several workers, it is one fine for the whole company.
Numeral 25.20 of the Labor Inspection Regulation counts "una infracción por cada trabajador" (one infraction per worker) not registered.
Registering you a week late is not an infraction, because in the end they did register you.
Numeral 24.2 makes it a serious infraction not to register, update or deregister "dentro del plazo correspondiente" (within the applicable deadline).

What is the difference between the T-Registro and the PLAME?
Together they make up Peru's electronic payroll (Planilla Electrónica). The T-Registro is where your employer registers you, updates your data and deregisters you. The PLAME is the monthly payroll, prepared from what is in the T-Registro (article 1(h) of D.S. 018-2007-TR).
When does my employer have to file the PLAME?
Every month, on the schedule SUNAT sets by resolution (article 5 of D.S. 018-2007-TR). This page does not reproduce that schedule; SUNAT publishes it separately.
How soon must I get my registration certificate?
On the business day after you start work. A certificate for a data change is due within fifteen calendar days, and the deregistration one only if you ask, within two calendar days of your request (article 4-A). It can be on paper or electronic, as long as there is proof you received it.
I was dismissed or I resigned. How long do they have to deregister me?
Until the first business day after the date your work ended (article 4-A).
They registered me with a start date later than my real one. Is that an infraction?
Numeral 24.2 makes it a serious infraction to file the payroll or register with false data or data that does not match reality, and not to register within the deadline. If you really started earlier, keep proof of when.
