Sunafil labor inspection in Peru: what can the inspector ask for on the day, and what happens next?

Short answer

A Sunafil inspector can enter without notice, review payroll, pay slips and other records, and interview workers, even alone. If they find violations, they give you a deadline to fix them; if you do not, they issue an infraction report. Refusing to cooperate is itself a very serious violation. You can answer the report with a written defense.

We did not check article by article whether any later rule amended these texts. Also, Ley 28806 (article 45) gives fifteen business days for a defense against the infraction report, while the Regulation, in its current text according to SPIJ (article 53), gives five business days for a defense against the notice of charges. We found no rule explaining how the two periods fit together. We do not give fine amounts: they are on the Sunafil fine table page.

The inspector can arrive without notice

A Sunafil inspection can start with a visit to your workplace, with a summons to an office (comparecencia) or with a check of data the State already holds. The visit is what surprises people most, because the law requires no notice. Article 5 of Ley 28806 allows the inspector to:

“Entrar libremente a cualquier hora del día o de la noche, y sin previo aviso, en todo centro de trabajo, establecimiento o lugar sujeto a inspección y a permanecer en el mismo.”

(Enter freely at any hour of the day or night, and without prior notice, any workplace, establishment or place subject to inspection, and stay there.)

The Regulation (D.S. 019-2006-TR, article 12) adds that the visit “puede extenderse el tiempo necesario” (can last as long as needed) and that there can be “más de una visita sucesiva” (more than one visit).

There is one limit: if the workplace is also the person’s home, the inspector needs their “expreso consentimiento o, en su defecto, la oportuna autorización judicial” (express consent or, failing that, a court authorization). The same article says the inspector identifies themselves with their credential.

What the inspector can do on the day

Article 5 of Ley 28806 gives the inspector these powers, among others:

  • Ask for documents. They can examine at the workplace “planillas y boletas de pago de remuneraciones” (payroll and pay slips), books, records, software, accounts, social security documents, occupational risk prevention documents and the income tax return. They can make copies and ask you to bring the documents to a public office.
  • Ask questions. They can question the employer or staff, “solo o ante testigos” (alone or in front of witnesses), and require anyone at the workplace to identify themselves.
  • Interview workers alone. The law says:

“Si los trabajadores evidenciaran temor a represalias o carecieran de libertad para exponer sus quejas, los Inspectores los entrevistarán a solas sin la presencia de los empleadores o de sus representantes, haciéndoles saber que sus declaraciones serán confidenciales.”

(If workers show fear of retaliation or are not free to state their complaints, the inspectors will interview them alone, without the employers or their representatives, and tell them their statements will be confidential.)

  • Take samples, measure, photograph and record, as long as the inspected party is notified.
  • Summon you. They can require the employer, its representatives or workers to appear at the workplace or at a public office.

On the other side is your duty to cooperate. Article 9 of Ley 28806 requires employers and workers to attend to the inspector, prove their identity, cooperate during the visit, answer questions about what is being investigated and “facilitarles la información y documentación necesarias” (give them the information and documents they need).

Obstructing the inspection is a separate violation

Many companies think that if the inspector does not get in, there is nothing to sanction. It is the other way round. Article 36 of Ley 28806 defines obstruction:

“La negativa injustificada o el impedimento a que se realice una inspección en un centro de trabajo o en determinadas áreas del mismo, efectuado por el empleador, su representante o dependientes, trabajadores o no de la empresa, por órdenes o directivas de aquél.”

(An unjustified refusal or blocking of an inspection at a workplace or in certain areas of it, by the employer, its representative or staff, whether or not they are company workers, on the employer’s orders.)

The same article makes clear that the blocking can be “directo o indirecto” (direct or indirect): delaying the inspector’s work, refusing them support, obstructing their investigation, or keeping workers or the union from taking part.

The Regulation (article 46) classifies these acts, among others, as very serious (muy graves):

  • Refusing the inspector entry to, or stay in, the workplace or an area of it.
  • Refusing to prove your identity or that of the people at the workplace.
  • Refusing to hand over the information and documents needed.
  • Walking out of, or not attending, an inspection step.
  • Not complying with a compliance order on time.
  • Not attending a comparecencia.
  • Coercing, threatening or using violence against the inspector.

We give no amounts here. They depend on the size of the company and the number of workers affected, and they are in the Sunafil fine table.

Warnings and compliance orders: the chance to fix things

If the inspector finds violations, it does not always go straight to a fine. Ley 28806 (article 5, numeral 5) allows the inspector to:

  • Warn you “en vez de extender acta de infracción, cuando las circunstancias del caso así lo ameriten, y siempre que no se deriven perjuicios directos a los trabajadores” (instead of issuing an infraction report, when the case warrants it and as long as workers suffer no direct harm).
  • Order you (requerimiento) to take, “en un plazo determinado” (within a set period), the steps needed to comply.

The Regulation (article 20.3) gives examples of what a compliance order can require: registering a worker on the payroll, paying outstanding wages and benefits, recognizing that a fixed-term contract is indefinite and keeping the worker on, among others.

The deadline decides the outcome. Article 17.3 of the Regulation says:

“Cuando el sujeto inspeccionado subsane las infracciones en el plazo otorgado por el inspector del trabajo en la medida de requerimiento, se emite el informe correspondiente dejando constancia del cumplimiento de las obligaciones fiscalizadas, sin perjuicio de la emisión de las recomendaciones o advertencias que correspondan, dando fin a la etapa de fiscalización.”

(When the inspected party fixes the violations within the period set in the compliance order, a report is issued recording compliance, and the inspection stage ends.)

If the period runs out without a fix, “se extiende el acta de infracción correspondiente” (the infraction report is issued) (article 17.2). If you fix things after the deadline but before you are notified of the charges, the investigating authority assesses that fix.

Two more details:

  • The compliance order cannot be challenged. Article 14 of Ley 28806 says so, “sin perjuicio del derecho de defensa de los interesados en el seno del procedimiento sancionador” (without prejudice to the right of defense in the sanction procedure).
  • For two violations against the inspection (walking out of or not attending an inspection step, and not attending a comparecencia), article 17.3 provides a 90% reduction of the sanction if you prove you fixed all the violations flagged before the infraction report, or when no violations are found.

The infraction report

The infraction report (acta de infracción) opens the way to a fine. It carries a lot of weight as evidence. Article 16 of Ley 28806 says:

“Los hechos constatados por los inspectores actuantes que se formalicen en las actas de infracción observando los requisitos que se establezcan, se presumen ciertos sin perjuicio de las pruebas que en defensa de sus respectivos derechos e intereses puedan aportar los interesados.”

(Facts recorded by the inspectors in infraction reports that meet the requirements are presumed true, without prejudice to the evidence the parties may bring in their defense.)

In practice, it is up to you to prove the facts are not as the report says. So keep a copy of everything you hand the inspector from the start.

Your written defense

After the report comes the sanction procedure, which has an investigation phase and a decision phase. You can file a written defense (descargos) in both. There is one point you need to know:

  • Ley 28806 (article 45) says that, “luego de notificada el Acta de Infracción” (once the infraction report is notified), you have “quince (15) días hábiles” (fifteen business days) to file your defense.
  • The Regulation, in its current text according to SPIJ (article 53), says that, “luego de notificada la imputación de cargos” (once the notice of charges is served), you file your defense “en un plazo no mayor de cinco (5) días hábiles” (within no more than five business days). And when you are notified of the final investigation report, you again have “no mayor de cinco (5) días hábiles”.

We found no rule explaining how the two periods fit together. The careful course is to act within the shorter period and to read closely the deadline stated in the document you receive.

If you are a worker

The inspection also works for you. The inspector must interview you alone if you fear retaliation, and Ley 28806 (article 13) requires confidentiality about whether a complaint exists and who filed it. You also have a duty to cooperate and to answer questions about what is being investigated (article 9). We do not cover fine amounts (they are in the Sunafil fine table), work stoppages or temporary closures for safety and health risks, appeals against the fine decision or collection of the fine. We also did not review decisions of the Labor Inspection Tribunal (Tribunal de Fiscalización Laboral) or Sunafil’s internal directive on refusal of entry. The texts we quote are the SPIJ consolidated versions as of 11 February 2022; we did not check later amendments article by article.

How to file

  1. Keep your employment records up to date and at handPayroll, pay slips, contracts, attendance records and workplace safety documents. The inspector can ask for them on the day of the visit and make copies.
  2. Receive the inspector and ask for their credentialLey 28806 says the inspector identifies themselves with their credential. Assign one person to attend them and do not block their way or their access to any area: that is a very serious violation.
  3. Comply with the order before the deadlineRead the deadline set in the compliance order (medida de requerimiento) and prove the fix to the Labor Inspectorate before it runs out. If you fix it in time, the inspection ends with a report, not an infraction report.
  4. If you are notified of charges, file your written defenseCheck the facts and the classification of each violation, and file your descargos with evidence. Under the Regulation, the period is no more than five business days from notification. Do not leave it to the last day.

Frequently asked questions

What documents can they ask for during the visit?

Article 5, numeral 3.3, of Ley 28806 lists, among others, books, records, software, accounts, social security documents, payroll and pay slips, occupational risk prevention documents and the income tax return. The inspector can make copies and ask you to bring the documents to a public office.

Can the inspector enter a private home?

If the workplace is also the person's home, the inspector needs their express consent or, failing that, a court authorization (article 5, numeral 1, of Ley 28806).

What is a comparecencia?

It is a summons to appear before the inspector, at the public office they name, with the documents they ask for or to give explanations (article 12 of the Regulation). Failing to attend is a very serious violation against the inspection (article 46.10).

How long can the investigation last?

Ley 28806 (article 13) says that, as a general rule, the investigation cannot last more than thirty business days, unless the delay is the inspected party's fault. The same article allows an extension when needed, except in workplace safety and health cases.

How much is the fine for obstructing an inspection?

The violations against the inspection in article 46 of the Regulation are very serious. The amount depends on the size of the company and the number of workers affected. We explain it on the Sunafil fine table page.

I am a worker. Do I have to talk to the inspector?

Ley 28806 (article 9) also requires workers to cooperate with inspectors, including answering questions about the inspection. If you fear retaliation, the inspector must interview you alone and your statement is confidential.
