What are your rights flying in Peru with a disability or reduced mobility?

Short answer

The airline must give you priority or assistance at boarding, also for your companion or certified assistance dog, and priority attention if you're denied boarding or the flight is delayed or cancelled (Decisión 619). The airport must have ramps, signage, adapted toilets and other accessibility measures (Ositrán's User Regulation).

Who is protected

Andean Community Decisión 619, which governs air passenger rights in Peru, defines a «usuario discapacitado o con necesidades especiales» (disabled user or user with special needs) as any passenger with «movilidad reducida (sensorial o de locomoción, permanente o temporal) o mental» (reduced mobility, sensory or physical, permanent or temporary, or mental) whose situation needs «una atención especial y la adaptación a sus necesidades de los servicios a disposición de todos los usuarios» (special attention and the adaptation of services available to all users). It adds: «Se incluye a los de tercera edad, niños menores de 5 años y mujeres embarazadas» (older people, children under 5 and pregnant women are included; art. 3).

Our reading is that a leg in a cast or recovery from surgery also counts, because the rule says «permanente o temporal» (permanent or temporary).

Peru’s Consumer Protection Code (Ley 29571) protects a similar group: pregnant women, children, older adults and people with disabilities (art. 41).

The airline: priority and priority attention

Article 10 of Decisión 619 has two parts.

At boarding. «Los transportistas aéreos, según el tipo de aeronave, darán prioridad y/o facilidades de embarque a las personas discapacitadas o con necesidades especiales y sus acompañantes o perros de acompañamiento certificados, así como de los menores no acompañados.» (Airlines, depending on the aircraft type, shall give priority and/or boarding assistance to people with disabilities or special needs and their companions or certified assistance dogs, and to unaccompanied minors.) The words «según el tipo de aeronave» leave room for what the aircraft allows. Our reading is that they don’t allow refusing all help: the duty is to give priority, assistance or both.

When something goes wrong. «En casos de denegación de embarque, interrupción del transporte, cancelación o retrasos de cualquier duración, las personas con discapacidad o con necesidades especiales y sus acompañantes, así como los menores no acompañados, tendrán derecho a recibir atención prioritaria.» (In cases of denied boarding, interrupted travel, cancellation or delays of any length, people with disabilities or special needs and their companions, and unaccompanied minors, are entitled to priority attention.) You don’t have to wait a set number of hours: it says «de cualquier duración» (of any length). This is on top of what every passenger gets; details are in delayed or cancelled flight and overbooking.

No worse terms. Article 24 says airlines, travel agencies and tour operators «no podrán otorgar o imponer condiciones inferiores o contrarios a los establecidos en la presente Decisión» (may not grant or impose conditions below or contrary to those in this Decision).

As a business. The airline is also a provider under the Consumer Code. Article 41.1 requires it to «garantizar la atención preferente» (guarantee priority service) for these people «en todos los sistemas de atención con que cuente» (in every service channel it has). Article 41.2 adds that it must «Adecuar su infraestructura en lo que corresponda e implementar medidas garantizando su acceso y seguridad» (adapt its infrastructure as needed and put in place measures guaranteeing their access and safety) and «Exonerarlos de turnos o cualquier otro mecanismo de espera» (exempt them from queues or any other waiting system). More in priority service.

The airport: terminal accessibility

Article 19 of Ositrán’s User Regulation says «las Entidades Prestadoras deberán adoptar las medidas de accesibilidad para personas con discapacidad, mujeres embarazadas y adultos mayores en las infraestructuras a su cargo» (operators must adopt accessibility measures for people with disabilities, pregnant women and older adults in the infrastructure they run). The Entidad Prestadora is the operator of the concessioned airport. Among the measures, the article lists:

  • «Construir rampas que permitan el fácil acceso de las personas con discapacidad, mujeres embarazadas y adultos mayores.» (Build ramps for easy access.)
  • «Colocar señalización adecuada, tanto visual como sonora.» (Proper visual and audible signage.)
  • «Adaptar los servicios higiénicos para el fácil uso de los Usuarios con discapacidad.» (Adapt toilets for users with disabilities.)
  • «Instalar teléfonos públicos que permitan su uso por personas con discapacidad.» (Install public phones usable by people with disabilities.)
  • «Implementar un ascensor, así como mobiliario especial en las salas de espera y de embarque» (a lift, and special furniture in waiting and boarding lounges).
  • Adapting «las cafeterías, tiendas y todo otro servicio» (cafés, shops and every other service) in the terminal so people with disabilities can use them.

If the operator fails to comply, Ositrán «pondrá en conocimiento dicha circunstancia a la autoridad competente para las acciones de supervisión y fiscalización» (will report it to the competent authority for supervision and enforcement), under Ley 29973, the General Law on Persons with Disabilities.

Decisión 619 also requires the airport operator to guarantee «facilidades para personas discapacitadas y con necesidad de atención especial, embarazadas o de edad avanzada» (facilities for people with disabilities or special needs, pregnant women and older people) and to «Proveer rampas y facilidades de acceso que permitan el desplazamiento de personas discapacitadas» (provide ramps and access so people with disabilities can move around; art. 21).

A law we could not read. Article 19 applies these measures «de acuerdo a lo previsto en la Ley Nº 28735» (as provided in Ley 28735). The Regulation itself names it as the «Ley que regula la atención de las personas con discapacidad, mujeres embarazadas y adultos mayores en los aeropuertos, aeródromos, terminales terrestres, ferroviarios, marítimos y fluviales y medios de transporte» (law on attention to people with disabilities, pregnant women and older adults at airports, terminals and in transport). We could not read its official text: Congress’s PDF is a scan with no text layer. So we don’t quote what it says.

What Indecopi has already decided

  • Latam, Arequipa (2026). Indecopi reported in August 2026 that its Chamber upheld a fine against Latam Airlines Perú for not boarding first a passenger with a disability who had told the airline about her condition in advance (Resolution 2826-2026/SPC-INDECOPI). It found a breach of article 41.2(c) of the Consumer Code. The summary is in our news item.
  • Sky, companion clause (2025). Sky had a clause letting staff deny boarding, at their sole discretion, if they judged a passenger needed a companion. In Resolution 0076-2025/SPC-INDECOPI, the Chamber reversed the sanction for that clause: it found the clause did not breach the clarity requirement in article 48(a) of the Code. Sky got no fine for that clause; the clause had already changed and the Commission will consider whether to open a new proceeding. We explain it in unfair airline terms. Our reading: that decision is about how clearly the clause was written; we found nothing showing it examined article 10 of Decisión 619.

What these rules don’t say

The texts we read don’t regulate using your own wheelchair in the cabin, oxygen on board, or the medical forms some airlines ask for. Each airline’s conditions govern that. Ask for them in writing before you buy and tell the airline what you need well in advance.

Where to complain

  • The airline didn’t give you priority or help: its Libro de Reclamaciones (complaints book) and, if it doesn’t resolve it, Indecopi.
  • The terminal isn’t accessible: the airport operator’s Libro de Reclamaciones; its answer can be appealed to Ositrán’s Tribunal.

Channels and deadlines are in where to complain at an airport.

How to file

  1. Tell the airline in advance, in writingWhen you buy or before the flight, tell the airline what help you need (wheelchair, help boarding, companion, assistance dog). Keep the confirmation.
  2. Ask for priority at boardingFor you and your companion. It's the airline's obligation (Decisión 619, art. 10).
  3. If there's a delay, cancellation or denied boarding, ask for priority attentionArticle 10 gives it to you in those cases, however long the delay.
  4. Complain to the airlineIn its Libro de Reclamaciones, the same day. Complaints are filed in Spanish. If there's no answer or no fix, go to Indecopi: Reclama Virtual to conciliate, or a denuncia if you want a sanction.
  5. Complain to the airport about what's missing in the terminalRamps, lifts, adapted toilets or signage: in the airport operator's Libro de Reclamaciones. Its answer can be appealed to Ositrán's Tribunal.

What most people believe — and what the law says

The belief

Priority boarding is a favour from the airline.

The law

It's an obligation. Decisión 619 says airlines «darán prioridad y/o facilidades de embarque» (shall give priority and/or boarding assistance) to people with disabilities or special needs and their companions (art. 10).

The belief

It only counts if your disability is permanent.

The law

Decisión 619 covers any passenger with «movilidad reducida (sensorial o de locomoción, permanente o temporal) o mental» (reduced mobility, sensory or physical, permanent or temporary, or mental). It also includes older people, children under 5 and pregnant women (art. 3).

The belief

My companion has to queue normally.

The law

Article 10 gives priority or boarding assistance to the person «y sus acompañantes» (and their companions), and priority attention during delays or cancellations to them as well.

The belief

If the terminal has no ramp or lift, that's the airline's problem.

The law

Terminal accessibility is the duty of the airport operator, the «Entidad Prestadora» (Ositrán User Regulation, art. 19). You complain to the operator, not the airline.

The belief

If the airline has an assistance protocol, it has done its part.

The law

In August 2026, Indecopi reported that its Chamber upheld a fine against Latam for not boarding a passenger with a disability first. It said priority service isn't met just by having protocols: they have to work.

Frequently asked questions

Can I fly with my assistance dog?

Article 10 of Decisión 619 names «perros de acompañamiento certificados» (certified assistance dogs) among those who get priority or boarding assistance. It doesn't regulate the conditions in the cabin; check your airline's conditions and tell them before the flight.

Do I need a disability certificate to ask for priority?

The articles we read don't require a specific document for priority boarding. Peru's disability certificate is used for other rights and procedures; having it with you can help if you're asked to show your condition.

What am I owed if my flight is delayed or cancelled?

On top of what every passenger gets, article 10 gives you «atención prioritaria» (priority attention) if you're denied boarding, the journey is interrupted, or the flight is cancelled or delayed «de cualquier duración» (of any length). Your companion too.

Can the airline refuse to board me because I'm travelling without a companion?

The rules we read don't address this directly. In 2025 Indecopi reviewed a Sky clause letting staff deny boarding if they judged a passenger needed a companion: the Chamber reversed the sanction because the clause did not breach the clarity requirement in article 48(a) of the Consumer Code. As far as we know, that decision did not examine article 10 of Decisión 619.

Where do I complain?

What the airline does or fails to do: in its Libro de Reclamaciones, then Indecopi. What's missing in the terminal (ramps, lifts, toilets): to the airport operator, then Ositrán.
