What are you owed when your flight is delayed or cancelled in Peru?

Short answer

Under Andean Community Decisión 619, a delay over 2 hours earns you a snack and a free call; over 4 hours, a meal as well; over 6 hours for reasons attributable to the airline, a minimum compensation of 25% of the value of the affected segment, plus a hotel if you must stay overnight, transfer costs, or a refund, at your choice.

Applying the article 8(a) waiting tiers to a passenger bumped for overbooking is our reading of article 6, which refers to article 8 without saying how that wait is measured.

The rule that governs: Decisión 619

Decisión 619 of the Andean Community (adopted in Lima on 15 July 2005) harmonises air passenger rights across Bolivia, Colombia, Ecuador and Peru. As Andean Community law, it applies directly, with no need for a Peruvian statute to repeat it. It covers delays, cancellations, interruptions and overbooking.

Who it covers (art. 2). Passengers who start their trip at an airport in one of those four countries; passengers who start in another country on an Andean airline with a destination or stop in one of them; passengers the airline or tour operator transfers at an Andean airport from the flight they were booked on, whatever the reason; and passengers on award or compensation tickets.

Delay (art. 8, paragraph a)

Delay is measured between the scheduled flight time and the «inicio del rodaje para decolar», the start of taxiing for take-off:

DelayWhat you are owed
Over 2 h and under 4 hA snack and a free communication (equivalent to a phone call of up to 3 minutes)
Over 4 h and under 6 hThe above, plus a meal (breakfast, lunch or dinner depending on the hour)
Over 6 hThe above, plus the paragraph e) compensation if the cause is attributable to the airline, and «adicionalmente» (in addition) a hotel if you must stay overnight, transfer costs, or a refund (immediate if you are away from home), «a elección del pasajero» (at the passenger’s choice)

The rule doesn’t make meals conditional on accepting a hotel: it gives them from 4 hours. One caveat written into paragraph a): if you voluntarily agree to keep waiting because the flight is expected to leave within a reasonable time, the airline is not bound to the last row.

The 25% compensation (art. 8, paragraph e)

Paragraph e) requires compensation “con una suma mínima equivalente al 25% del valor del trayecto incumplido, pagadera en efectivo o en cualquier otra forma aceptada por el pasajero” — tickets, vouchers, miles — in two cases:

  • overbooking, unless there was a direct agreement in which you voluntarily accepted not to fly; and
  • a delay over 6 hours for reasons attributable to the airline.

The segment’s value is the net ticket price (excluding taxes, fees and charges, per article 3) multiplied by the share of the affected segment’s distance over the total distance. It is a minimum: the airline may give more, not less.

On a long trip, 25% can be small. On a round trip of about 14,000 km, missing a segment of about 1,140 km on a USD 566 net fare gives a minimum of about USD 11.50, sometimes less than the counter offers. What the rule guarantees is the form: cash if you want it. The paragraph a) assistance is separate.

Connections (paragraph f). The compensation also applies, «en lo pertinente» (as relevant), if you are in transit or connecting and can’t continue because of the airline. Under article 3, a connection is a continuous movement on one ticket with no stopover.

Cancellation (arts. 7 and 8.c)

If the airline cancels for reasons attributable to it, article 7 requires it to give you assistance under paragraph c) of article 8, and boarding on the next flight with space, alternative transport (preferably by air), or a full refund without penalty. Paragraph c) adds a hotel if you must stay overnight and transfers when you were neither refunded nor rebooked the same day, and the delay compensations if there was a wait before the cancellation.

The airline is released if it told you at least 15 days ahead, or with less notice but offering another flight. Nor does it owe the article 8 compensations if the cause was unforeseen circumstances, force majeure or an act of God «debidamente verificadas por la autoridad nacional competente» (duly verified by the national authority).

Overbooking (art. 6)

Before denying boarding, the airline “deberá, en primer lugar, pedir que se presenten pasajeros voluntarios que renuncien a sus reservas a cambio de determinados beneficios”. Volunteers receive what they agree to and, in addition, the assistance in paragraphs a) and e) of article 8, as applicable.

Only if there aren’t enough volunteers can it bump passengers against their will, and then it «deberá compensarles, reembolsarles y asistirles en los términos que se indican en el artículo 8» (must compensate, refund and assist them on the terms of article 8). That includes the airline’s next flight with space on the same date and route, or another airline at its expense (paragraph d), and the 25% minimum (paragraph e). What you are owed while you wait, what to do with the counter voucher and what not to sign is in the overbooking guide.

What the airline must tell you (art. 4(h))

On overbooking, cancellation or delay, the airline must inform you «en la forma más idónea posible, de preferencia escrita» (in the most suitable way, preferably in writing) of your rights, especially compensation and assistance. If it didn’t, put that in your complaint.

They can’t give you less (art. 24)

Airlines, travel agencies and tour operators «no podrán otorgar o imponer condiciones inferiores o contrarios» (may not grant or impose lesser or contrary conditions) to Decisión 619. Our position is that conditions such as paying less in cash than in vouchers, or refusing meals unless you take the hotel, run into this article.

Indecopi has already confirmed as abusive airline terms-and-conditions clauses that allowed changing the trip for reasons other than caso fortuito or fuerza mayor (unforeseeable events or force majeure); we summarise them in the unfair airline terms Indecopi has already sanctioned.

Refunds and priority care

Refunds (art. 11). For causes attributable to the airline, it refunds the unflown part, or the whole ticket if the trip no longer makes sense for your plans, plus a flight back to your starting point. The deadline is five (5) business days.

Priority care (art. 10). People with disabilities or special needs and their companions, and unaccompanied minors, get priority in any denied boarding, interruption, cancellation or delay of any length. Article 3 counts older adults, children under 5 and pregnant women as having special needs.

Transferring or postponing the ticket

Endorsing or transferring (Ley 32325). The Civil Aviation Law, as amended by Ley 32325 (published 9 May 2025), lets the ticket holder endorse or transfer it to someone else up to 24 hours before the flight time, «sin costo alguno» (at no cost), provided the contract conditions stay the same. The airline issues the new ticket in the other person’s name free of charge and must offer digital channels for it. If it refuses, except in force majeure or an act of God, the law says the civil aviation authority sanctions it «de acuerdo con la infracción señalada en el reglamento» (under the infraction set in the regulation), and you can claim damages. As of 11 October 2026 that regulation had not yet been adapted to Ley 32325 (see “Possible changes ahead”). Details in the air ticket endorsement guide.

Postponing (Ley 29571, art. 66.7). For domestic transport, the Consumer Code lets you postpone the service on the same terms with at least 24 hours’ notice, paying only the real cost of issuing the new ticket. Ley 32325 doesn’t cover postponement.

Where to complain

Indecopi is the consumer authority competent for air passenger complaints in Peru. The concrete steps are above. For international flights, the rules of the destination country or of the international convention on your ticket may also apply; we do not cover those here. If you are still at the airport and don’t know who to complain to, see where to complain at a Peruvian airport: airline, airport operator, Indecopi or Ositrán.

Calculate it

The flight compensation calculator tells you what is owed for your situation (delay, cancellation or overbooking) and works out the 25% minimum from the airport codes on your itinerary. For the counter, the passenger rights card puts the articles on one screen.

How to file

  1. Document the delay at the airportPhoto of the board with the original and new time, boarding pass, any airline notice. What counts is when the plane actually starts taxiing for take-off against the scheduled time.
  2. Ask at the desk for what your delay band entitles you toName article 8 of Decisión 619: snack and call (over 2 h), meal (over 4 h), and from 6 h, if the airline caused it, compensation plus a hotel if you must stay overnight, transfer or refund, at your choice. Ask to be told your rights, preferably in writing (art. 4(h)). Keep receipts for anything you pay yourself.
  3. The airline's libro de reclamacionesEvery airline with an office in Peru must have one, physical or online. Record the complaint the same day.
  4. Complain to IndecopiIndecopi handles air passenger complaints in Peru. Reclama Virtual to settle; a denuncia if you want a sanction.

Rule still to be issued

Adaptation of the Ley 27261 Regulation to Ley N.º 32325 (Ley 32325, Disposición Complementaria Final Única)

Where it stands
Ley 32325 (El Peruano, 9 May 2025) ordered the Executive to adapt the Civil Aviation Law Regulation (D.S. 050-2001-MTC) within thirty business days. As of 11 October 2026 no supreme decree doing so appears in the MTC's official list of supreme decrees; the only one that has amended that regulation since, D.S. 007-2026-MTC, deals with ticket price information.
What it would change
It would set out in the regulation how endorsement is requested and which infraction and fine the civil aviation authority applies to an airline that refuses. The right to free endorsement is already in the law.
How it would take effect
Publication in El Peruano of a Ministry of Transport and Communications supreme decree amending D.S. 050-2001-MTC.
When
No date: the legal thirty-business-day deadline passed in 2025.

Bill in Congress

Bills N.º 2210/2021-CR and 2956/2022-CR (joined): seat selection and carry-on baggage at no extra cost

Where it stands
The plenary approved it in a first vote on 11 June 2025. A reconsideration of that vote was filed the next day, and on 26 July 2025 it went back to the order of business at the end of the legislative session. The file shows no later steps as of 11 October 2026. It is not law.
What it would change
Under the substitute text, it would amend Ley 27261 to recognise the right to choose a seat and a minimum carry-on allowance at no extra cost, on domestic and international flights.
How it would take effect
The reconsideration would have to be resolved, the bill approved in a second vote (unless waived), promulgated by the Executive or passed over its objection, and published in El Peruano.
When
No date.

What people fail to ask in time

The airline is not answering your complaint: do you know who hears it next and how it is filed?

Find out before it matters →

What most people believe — and what the law says

The belief

Delays are normal; the airline owes nothing.

The law

Over 2 hours they already owe you a snack and a free call. Over 4, a meal. Over 6 for reasons attributable to the airline, cash compensation, and a hotel if you must stay overnight, transfer costs or a refund, at your choice (art. 8 of Decisión 619).

The belief

That's a European rule; it doesn't apply here.

The law

Decisión 619 is Andean Community law and, as such, applies directly in Peru without any domestic statute repeating it.

The belief

When a flight is overbooked, the airline picks who gets bumped.

The law

Article 6 requires it to ask first for volunteers who give up their seat in exchange for benefits. Only if there aren't enough can it bump someone against their will, and then it must compensate, refund and assist them under article 8.

The belief

I only get a meal if I accept the hotel.

The law

Article 8(a) gives meals from 4 hours of delay and doesn't tie them to lodging. Lodging comes after 6 hours, only if an overnight stay is needed, alongside transfer or refund, «a elección del pasajero» (at the passenger's choice).

The belief

An air ticket can never be transferred to someone else.

The law

Ley 32325 lets you endorse or transfer an air ticket up to 24 hours before the flight, free of charge, if the contract conditions stay the same (art. 101.4 of Ley 27261). Postponing is a different thing: for domestic transport it's governed by article 66.7 of Ley 29571.

The belief

Compensation is whatever the airline offers — a meal voucher.

The law

Paragraph e) of article 8 sets a minimum of 25% of the value of the affected segment, 'pagadera en efectivo o en cualquier otra forma aceptada por el pasajero'. Accepting miles or vouchers is your choice, not theirs.

Frequently asked questions

From what exact moment is a flight delay counted?

Article 8 measures the delay in the 'iniciación del vuelo (inicio del rodaje para decolar)' against the scheduled time: it's the gap between the scheduled time and when the plane actually starts taxiing for take-off, not boarding time or landing time.

What happens if I voluntarily agree to wait longer because the flight will leave within a reasonable time?

If you voluntarily agree to extend the wait because it's foreseeable the flight will depart soon, Decision 619 says the airline isn't required to give you the lodging, transfer or refund of the over-6-hour tier. It's an express carve-out in article 8(a).

How is the exact amount of the 25% compensation calculated?

The segment value is the ticket's net value (excluding taxes, fees and charges) multiplied by the share of the uncompleted segment's distance over the total trip distance. The 25% minimum applies to that value. On a long itinerary with connections the result can be small; the calculator does it for you from the airport codes.

Does Decisión 619 apply if my trip started in the US or Europe?

It can. Article 2 covers passengers who start in another country on an Andean airline with a destination or stop in one of the four countries, and passengers the airline or tour operator transfers at an Andean airport from the flight they were booked on, whatever the reason. We read a rebooking after denied boarding as falling in that last case. Check the rules of your departure country too; this page doesn't cover them.

What should I do at the airport if the airline doesn't address my complaint?

Record it the same day in the airline's complaints book (libro de reclamaciones), which every airline with an office in Peru must have, whether physical or virtual. If it isn't resolved, you can file with Indecopi through Reclama Virtual to seek conciliation, or file a formal complaint (denuncia) if you want a sanction.
