Reclamo, queja or denuncia: which one do you file in Peru?
A reclamo is about the product or service; a queja is about how you were treated; a denuncia is a formal filing before Indecopi that opens a sanctioning procedure. Only a reclamo opens the door to a consumer case on the substance.

The definition of queja (article 3.4) and the wrongly-ticked-box rule (article 6) are quoted from the DS 101-2022-PCM text published in El Peruano; the response deadline in force was confirmed in Ley 31435 and DS 101-2022-PCM. Indecopi charges a fee to file a denuncia, but we did not confirm the amount and therefore do not state it.
The clock running against you

Reclamo: about what you bought
A reclamo is a grievance about the goods or the service. The product that fails, the delivery that never arrives, the charge that should not be there, the service that is not what was offered. It goes in the business’s complaints book, and the business must attend to it and answer within fifteen business days.
It is the only one of the three that argues the merits between you and the company. That is why it is the natural first step before a consumer case.
Queja: about how you were treated
Article 3.4 of the regulation, as worded by DS 101-2022-PCM, defines a queja in two ways: a grievance that “no se encuentra relacionada a los bienes expendidos o suministrados o a los servicios prestados” (is not related to the goods or services provided), and the “malestar o descontento del consumidor respecto a la atención al público” (the consumer’s discontent with customer service). Everything that is not the product: the attention, the wait, the attitude of staff, the state of the premises.
Since DS 101-2022-PCM a queja carries the same fifteen-business-day response deadline as a reclamo. Its function is different, though: it puts something on record. It does not by itself open a discussion about the product.
If the problem is the product and you tick queja, or no box at all, the rule puts the burden on the business:
“En el caso que, de la lectura del detalle de la reclamación, se evidencie que se trata de un reclamo, aun cuando el consumidor haya marcado erróneamente la opción “queja” de la Hoja de Reclamaciones o no haya marcado ninguna opción, el proveedor deberá darle el trámite de un reclamo, conforme a lo establecido en el presente Reglamento.”
(If the details show it is a reclamo, even though the consumer wrongly ticked “queja” or ticked nothing, the business must handle it as a reclamo.)
Still, tick reclamo: that way you do not depend on the business reading your sheet correctly. The rule does not cover the opposite case, a queja ticked as reclamo.
Denuncia: the formal filing before Indecopi
A denuncia does not go in any book. It is a written filing to Indecopi, today almost always through its Mesa de Partes Virtual, asking it to open an administrative sanctioning procedure against the business. Indecopi investigates, the business defends itself, and it can end in a fine.
Indecopi separates it from the reclamo with a sentence worth memorising: “Un reclamo no es una denuncia ni inicia un proceso sancionador contra un proveedor.” Many people fill in the book, wait, and believe they have reported the business. They have not.
A denuncia carries a filing fee. We have not confirmed the amount, so we do not print one.
And Reclama Virtual?
The third route that gets confused with the other two. Reclama Virtual is Indecopi’s portal for lodging a reclamo with the agency and seeking a conciliation with the business. It is free and you identify yourself with your document. It sanctions nobody: if you want a sanction, that is a denuncia.
If you are not sure which box to tick, the Reclamo or queja? tool tells you in three questions.
Which to choose
- You want a refund, replacement or repair → reclamo in the book, then Reclama Virtual if they do not answer.
- You want the poor treatment on record → queja in the book.
- You want Indecopi to investigate and sanction → denuncia through the mesa de partes.
You can do more than one. What you cannot do is file one believing you filed another.
Was the problem with a taxi or a ride-hailing app?
Rides booked through apps like Uber or Cabify sit in a legal gap in Peru: there’s no unified national law for these platforms. Check taxi and ride-hailing apps in Peru: passenger rights to understand what you can claim and to whom.
How to file
- Decide what your problem isIs it the product or the service (faulty, never delivered, overcharged)? That is a reclamo. Is it the treatment, the wait, the staff's attitude? That is a queja. If both, log both, separately.
- Record it in the business's bookTick the right box. Keep your copy. From that moment the business has fifteen business days, not extendable, to answer.
- If they don't answer or the answer is useless, use Reclama VirtualIt is free, you identify yourself with your document, and it seeks a conciliation with the business. It sanctions nobody.
- If you want the business sanctioned, file a denunciaIt goes through Indecopi's Mesa de Partes Virtual. There is a filing fee whose amount we have not confirmed. It opens an administrative sanctioning procedure.

What most people believe — and what the law says
Reclamo and queja mean the same thing; it doesn't matter which box I tick.
It matters. The regulation defines a queja as a grievance that is not about the goods or the service. If your problem is with what you bought and you tick queja, the business must still handle it as a reclamo (article 6 of the regulation, DS 101-2022-PCM text). Ticking the right box saves you that argument.
I wrote in the complaints book, so Indecopi already knows.
The book belongs to the business, not to Indecopi. Indecopi puts it in these words: «Un reclamo no es una denuncia ni inicia un proceso sancionador contra un proveedor».
Filing through Reclama Virtual means I have reported the company.
Reclama Virtual is a conciliation channel: free, and it sanctions nobody. A denuncia is a separate filing through the mesa de partes, and that one does open a sanctioning procedure.
If my queja goes nowhere, that's the end of it.
A queja records the poor treatment. If there was also a problem with the product or service, that is a separate reclamo and can follow its own path.
Frequently asked questions
How long does a provider have to respond to a reclamo or queja?
In both cases, the deadline is fifteen business days, with no extension, counted from when it's logged in the complaints book. This is set out in Article 24.1 of Law 31435 and Articles 6 and 6-B of the Complaints Book Regulation, as amended by DS 101-2022-PCM.
Does it cost money to file a reclamo, a queja, or a denuncia?
Filing a reclamo or a queja in the complaints book is free, as is using Indecopi's Reclama Virtual. Filing a denuncia with Indecopi through its Virtual Filing Desk does carry a fee, though this page does not confirm the amount.
What do I do if the provider doesn't respond to my reclamo in the book?
You can turn to Indecopi's Reclama Virtual, a free portal where you identify yourself with your ID and the platform seeks a conciliation with the provider; it doesn't sanction anyone. If you want Indecopi to investigate and sanction the company, the path is filing a denuncia through the Virtual Filing Desk.
Can I file both a reclamo and a denuncia over the same problem?
Yes. A reclamo, a queja, and a denuncia serve different purposes, and you can use more than one at the same time; the only mistake is filing one while believing it's another, since each follows its own process and produces a different effect.
