Can you be admitted for mental health care in Peru without your consent? Admission, rights and discharge under Ley 30947

Short answer

As a rule, no. Peru's Mental Health Law requires your informed consent and treats hospitalization as an exceptional measure. The only exception is a psychiatric emergency in which you cannot express your will: your chosen support person signs or a court is asked to appoint one, and the order expires after 12 hours, up to 72.

Peru’s Mental Health Law, Ley 30947, starts from a simple idea: a person with a mental health problem decides about their own treatment, like any other patient. Article 9 lists these rights, among others:

“7. Otorgar su consentimiento informado, que implica la aceptación libre, sin persuasión indebida y otorgada por una persona con problemas de salud mental, o por sus representantes, según sea el caso, después de habérsele proporcionado información precisa, suficiente y comprensible sobre el diagnóstico, tratamiento, medidas alternativas posibles y efectos secundarios y riesgos. 8. Ser informado sobre su derecho a negarse a recibir o continuar el tratamiento y a que se le expliquen las consecuencias de esa negativa.”

(You have the right to give informed consent: free agreement, without undue pressure, after being given accurate and understandable information on the diagnosis, treatment, alternatives, side effects and risks. You also have the right to be told you can refuse to start or continue treatment, and what refusing means.)

Hospitalization is the exception, not the starting point. Article 27.1 of the law calls it “un recurso terapéutico de carácter excepcional, revisable periódicamente” (an exceptional therapeutic resource, reviewed periodically), used only when it helps more than other options, “por el tiempo estrictamente necesario y en el establecimiento de salud más cercano al domicilio del usuario” (for as long as strictly necessary and at the facility closest to the patient’s home).

Nobody can force you into an evaluation either. Article 16.1 of the regulation: “La evaluación en salud mental es voluntaria.” (A mental health evaluation is voluntary.)

Two different words: internamiento and hospitalización

The regulation (D.S. 007-2020-SA) uses two terms you will hear in Peruvian hospitals:

The only exception: an emergency in which you cannot decide

Article 27.2 of the regulation says of emergency admission: “Se realiza previo consentimiento informado otorgado por el(la) usuario(a), siendo la única excepción la imposibilidad para expresar la voluntad en un contexto de emergencia psiquiátrica” (requires the patient’s prior informed consent, the only exception being inability to express one’s will during a psychiatric emergency).

Even then, somebody has to take responsibility for the decision, and it is not just anyone. Article 26.4 sets the order:

  1. First, “reales, considerables y pertinentes” (real, substantial and relevant) efforts to help you express your will, including support for making the decision.
  2. If that fails, the signature of “el apoyo con facultades de representación designado por el(la) usuario(a) para tal fin” (the support person with powers of representation whom you designated for this).
  3. If you have no designated support person, the health service “procede a solicitar ante el juzgado de familia o mixto la designación excepcional de apoyos con facultades para autorizar el internamiento” (asks a family or mixed court to appoint support persons, as an exception, with power to authorize the admission).

This is the court’s role in an emergency admission: if there is no support person you chose, a judge decides who may authorize it. The rules do not mention a relative signing simply because they are family. If a relative is your designated apoyo, they sign in that role.

And the exception ends when the emergency does. Article 26.5: “Una vez resuelta la situación de emergencia, cualquier tratamiento, procedimiento, internamiento u hospitalización, requiere necesariamente del consentimiento informado de la persona” (once the emergency is resolved, any treatment, procedure, admission or hospitalization necessarily requires the person’s informed consent).

How long an admission order lasts

Article 27.7 of the regulation sets a short clock:

“La vigencia de la orden de internamiento expira a las 12 horas de ser emitida, pudiéndose repetirse hasta por un máximo de 72 horas continuas, siguiendo el procedimiento inicial y actualizando el consentimiento. Agotado el periodo máximo de 72 horas es obligatorio intentar procedimientos de cuidado comunitario.”

(An admission order expires 12 hours after it is issued. It can be repeated up to a maximum of 72 continuous hours, following the same procedure and renewing consent. After 72 hours, community-based care must be tried.)

A doctor issues the order, and it must be justified in the medical record. If a hospital stay is considered after the 72 hours, that stay needs your consent (article 27.3). If it lasts more than 30 days, the psychiatric medical board reviews the case, and staying longer requires “la actualización del consentimiento informado” (renewed informed consent) (article 27.4).

While you are admitted, a doctor sees you at least once a day and each time reviews whether treatment could continue another way (article 27.11). You or your designated representative can ask for the order to be lifted, and the request must be handled “con diligencia” (promptly) (article 27.12).

When a judge orders it

Court-ordered hospitalization has its own rules. The regulation says such orders “sólo proceden en casos de medidas de seguridad u otros establecidos por ley” (are only valid for security measures or other cases set by law) (article 29.1). The law distinguishes:

  • Criminal judge. Can order hospitalization as a security measure after a hearing with the prosecutor (Ministerio Público) and the defence lawyer, which “se lleva a cabo en un plazo no mayor de 48 horas de recibida la evaluación psiquiátrica” (takes place within 48 hours of receiving the psychiatric evaluation). It cannot exceed what the medical board considers necessary, and the hospital director “Informa al juzgado correspondiente cada tres semanas” (reports to the court every three weeks) (article 29, points 2 and 3, of Ley 30947).
  • Civil or family judge. The duration of admissions ordered by these judges “es definido por la junta médica del establecimiento” (is set by the hospital’s medical board) (article 29, point 5).

Your rights on the ward

Article 9 of the law is specific:

“13. No ser privado de visitas durante el internamiento u hospitalización cuando estas no estén contraindicadas por razones terapéuticas y nunca por razones de sanción o castigo. 14. Recibir la medicación correspondiente con fines terapéuticos o de diagnóstico y nunca como castigo o para conveniencia de terceros. 15. La libertad de movimiento y comunicación con el interior y exterior del establecimiento, siempre y cuando sea compatible con el tratamiento programado.”

(You cannot be denied visits unless there is a clinical reason, and never as a sanction or punishment. Medication is for treatment or diagnosis, never as punishment or for other people’s convenience. You keep freedom of movement and communication inside and outside the facility, as long as it fits your treatment plan.)

The regulation goes further. It bans “la existencia de cuartos y pabellones cerrados con llave o enrejados” (locked or barred rooms and wards) (article 27.14) and “el uso de cualquier medida restrictiva en todos los servicios de salud” (any restrictive measure in any health service), including “las intervenciones sin su consentimiento” (interventions without consent) and “el uso de cuartos de aislamiento” (isolation rooms) (article 28).

You also have the right not to be discriminated against or stigmatized for a mental health problem, and to be heard and answered if you are unhappy with your care: the service “debe contar con mecanismos claros para la recepción, tratamiento y resolución de quejas” (must have clear ways to receive, process and resolve complaints) (article 9, points 17 and 21).

Discharge

Leaving is not the end of care. The law says: “Al momento del alta médica, debe asegurarse la continuidad de cuidados de la salud ambulatorios que requiere cada caso” (at discharge, the outpatient follow-up each case needs must be ensured) (article 27.2), and the regulation repeats that the facility “asegura la continuidad de cuidados” (ensures continuity of care) (article 27.6).

If you have been medically discharged but are still in hospital for reasons outside your control, for example because nobody comes to collect you, the law requires referral to social work to reach your family and community (article 30). If no relatives can be found, you are moved to a protected home and, only as an exception, to a state residential care centre, where outpatient treatment continues (article 31).

How to file

  1. Ask for a full explanation before you agreeYou have the right to accurate, sufficient and understandable information on the diagnosis, treatment, alternatives and risks, and to say no (article 9 of Ley 30947). If you need communication support or a trusted person with you, ask for it.
  2. After an emergency admission, ask who authorized it and when the order expiresThe order is issued by a doctor, must be justified in the medical record, expires after 12 hours and cannot run past 72 continuous hours (article 27.7 of the regulation). If you could not consent, your designated support person should have signed or the court should have been asked to appoint one (article 26.4).
  3. If you disagree, ask in writing for the order to be liftedYou or your designated representative can make this request and it must be handled promptly (article 27.12 of the regulation). Keep a copy with the date and time.
  4. If nobody listens, file a complaintThe health service must have clear ways to receive and resolve complaints (article 9, point 17, of Ley 30947). You can also go to SUSALUD or the Ombudsman's Office (*Defensoría del Pueblo*); see the linked pages below.

What most people believe — and what the law says

The belief

If the family wants to, they can have someone admitted to a mental health service even if that person says no.

The law

The regulation requires the person's own informed consent to admit or hospitalize them. The only exception is a psychiatric emergency in which they cannot express their will, and even then the support person they chose signs, or a family or mixed court is asked to appoint one (articles 26.4 and 27.2 of D.S. 007-2020-SA). The rules do not give that power to a relative just for being a relative.

Once you are admitted, you stay until the doctor decides.

An emergency admission order expires after 12 hours and cannot run past 72 continuous hours (article 27.7 of the regulation). Hospitalization needs your consent, is reviewed after 30 days and only continues if you renew your consent (articles 27.3 and 27.4). On a mental health ward they can lock you in or isolate you if you cause trouble.

The regulation bans rooms and wards that are locked or barred (article 27.14) and bans isolation rooms and any restrictive measure (article 28).

Ley 30947 says visits can never be withheld as a sanction or punishment, and medication is given for treatment or diagnosis, never as punishment or for the convenience of others (article 9, points 13 and 14).

Frequently asked questions

What is the difference between internamiento and hospitalización?

The regulation treats them separately. *Internamiento* is the response to a psychiatric emergency, to prevent an imminent danger to life or lasting disabling harm (article 27.2). *Hospitalización* is for assessment, diagnosis or stabilization that cannot be done as an outpatient and needs round-the-clock support (article 27.3). Both require your consent; only emergency *internamiento* allows the exception that you cannot express your will.

My relative is in crisis and cannot decide. Who signs?

Under article 26.4 of the regulation, staff must first make real efforts to help the person express their will, including support for making the decision. If that is not possible, the support person with powers of representation whom the person designated signs. If there is none, the health service asks a family or mixed court to appoint support persons as an exceptional measure. Once the emergency is over, any treatment again needs the person's own consent (article 26.5).

Can I ask to leave early?

Yes, you can ask. Article 27.12 of the regulation says requests by you or your designated representative to lift an admission or hospitalization order must be handled promptly and decided through shared decision-making. The law also gives you the right to refuse to start or continue treatment and to have the consequences explained (article 9, point 8).

What if a judge orders the hospitalization?

In criminal cases, the judge can order hospitalization as a security measure after a hearing with the prosecutor and the defence lawyer, for no longer than the medical board considers necessary; the hospital reports to the court every three weeks (article 29 of Ley 30947). When the order comes from a civil or family judge, the medical board of the hospital sets how long it lasts. The regulation adds that such orders are only valid for security measures or other cases set by law (article 29.1).

What if a child needs to be hospitalized?

Hospitalizing a minor requires the consent of their legal representative (article 27.3 of the regulation), and it takes place in units reserved for their age group, which must allow parents or guardians to be with them (article 27.15).

Can my employer or university require a mental health certificate?

Only if a rule provides for it. Article 16 of the regulation says a mental health evaluation is voluntary, and that asking for mental health certificates or psychological reports for school, work or administrative procedures without a prior legal, regulatory or sector rule is discriminatory.
