What fines and sanctions can Migraciones impose on me in Peru?

Short answer

Three: a fine, salida obligatoria (compulsory departure, with a re-entry ban of up to 5 years) and expulsión (up to 15 years). The fine amounts are in article 190 of the regulation and are percentages of the UIT: 0.1% per day of overstay, 1% per month without updating your carné, 10% for working outside your migratory status. No sanction is ever applied to children or adolescents.

What we read and what we did not

The article 190 amounts were read in the official edition «MIGRACIONES: Ley y Reglamento» published by the Superintendencia Nacional de Migraciones, which consolidates the regulation up to DS 003-2023-IN (April 2023).

Read moreRead less

Two things remain open and we say so here: the daily aggravating factor in sub-paragraph d) is set by Migraciones in a Superintendencia resolution and is not in the regulation, so we cannot give you a total; and the regulation has not been republished in consolidated form since DL 1582 (November 2023) amended the statute, so always ask for the written assessment and its legal basis. Decreto Legislativo 1687 (October 2024) amends article 53 of the statute again, to give the Ministry of Foreign Affairs sanctioning power in some cases; that change takes effect only on the day after the supreme decree adapting the regulation is published, and we have not confirmed that it has been. We quote article 53.3 as worded by DL 1582, which is the text in force in the meantime.

Foreign residents

The three sanctions (article 54)

The Immigration Act does not leave the sanction to an official’s discretion. Article 54 sets three, and only three:

SanctionWhat it meansRe-entry ban
Multa (fine)Payment of an amount calculated on the UITNone, but an unpaid fine can block your entry (art. 48)
Salida obligatoria (compulsory departure)You must leave the countryUp to 5 years
Expulsión (expulsion)You are removed from the countryUp to 15 years

All three are imposed by a Migraciones resolution at the end of a sanctioning procedure, and are executed immediately (article 64). In that procedure you must be notified that it has started, and you have five business days from the day after that notice to file a written defence (article 209.1 of the regulation, as worded by Decreto Supremo 011-2024-IN). If that did not happen, it is an argument for your lawyer.

Who cannot be sanctioned

Article 53.3, as worded by DL 1582, says it in one sentence worth memorising: «En ningún caso MIGRACIONES aplica sanciones a niñas, niños y adolescentes» (in no case does MIGRACIONES apply sanctions to children and adolescents). Article 66 adds persons with absolute incapacity. Anyone threatening to fine or expel a minor is outside the law.

Grounds for a fine (article 56, DL 1582 text)

DL 1582 split article 56 in two:

Automatic fines (imposed when you leave the country): overstaying; leaving under a different nationality from the one you entered with.

Calculated fines: not updating the information on your carné de extranjería; overstaying when you apply to regularise; carrying out activities your migration status does not allow.

Grounds for compulsory departure (article 57)

Being in irregular status through overstay without having applied to regularise, and environmental-conduct sanctions imposed by the competent authority.

Grounds for expulsion (article 58.1)

a) False documents or false information in an immigration procedure. b) Reoffending on the compulsory-departure grounds. c) Not complying with a compulsory departure. d) Irregular status through entry without immigration control. e) Acts against cultural heritage. f) Activities against public order, internal order, national security or citizen security. g) Court order. h) Release after serving a sentence or on a prison benefit. j) Failing to identify yourself to the competent authority — added by Ley 32192 in December 2024.

Article 58.2 refers to the asylum and refugee rules. If you are an asylum seeker or a refugee, that reference matters.

The amounts, article by article

For years the received wisdom was that the amount is written down nowhere. It is. Article 190 of the regulation (DS 007-2017-IN) sets five grounds and their percentage of the UIT, and the Seventh Final Complementary Provision explains what that much-cited “Tabla de Infracciones y Sanciones” actually is: Migraciones approves it by resolution to publicise the infractions and sanctions already contained in the regulation. The table creates no new amounts. These are the amounts:

GroundFineUnit
Overstaying, charged at departure0.1% of the UITper day of overstay
Using more than one nationality interchangeably5% of the UITfixed
Not updating the carné de extranjería1% of the UITper month
Not requesting a residence extension0.67% of the UIT baseplus a daily aggravating factor
Activities your migratory status does not allow10% of the UITfixed

This is where the forum confusion comes from: the “1%” is monthly, and it is about an out-of-date carné, not daily and about expired residence. Expired residence is sub-paragraph (d), and it works differently: a fixed 0.67% base plus a per-day aggravating factor Migraciones sets separately. They are different infractions, not two versions of one rule.

Three details that change the arithmetic:

  • The UIT that counts is the one in force on the day of the infraction, not the day you pay (article 188.2). If you overstayed in 2024, the 2024 UIT applies.
  • The daily aggravating factor in (d) is not in the regulation. Migraciones sets it by Superintendencia resolution. That is why we can give you the base and not the total.
  • Paying the fine unlocks regularisation. Article 188.3 says so: once it is paid, you can start the procedure to put your migration status in order.

Peruvians can be fined too

Article 189 is rarely discussed and applies to nationals: leaving the country on a document different from the one you entered on costs 5% of the UIT. The exception is where an international treaty recognises the other document as a valid travel document proving the same nationality.

Sometimes the fine is the hotel’s, not yours

Article 192 of the regulation, as worded by Decreto Supremo 011-2024-IN (October 2024), fines legal entities that provide lodging services: 1 UIT for not asking you for your travel or identity documents, 1 UIT for lodging you without recording your nationality, date of birth, full name and document number, and 2 UIT for not sending that record or information to Migraciones. The same decree also requires the lodging to transmit your details to Migraciones at check-in (article 182.1, letter d). If a hotel insists on photocopying your carné, this is why — though what the rule requires of them is to ask and record, not to keep your document.

What changed in 2023 and 2024

DL 1582 added duties that touch your daily life even if you are never sanctioned: every public or private entity must verify that you are in regular migration status (article 10-A); a Código Único de Extranjero was created (article 11-A); interprovincial transport companies must check your documents (article 60-A); and a police administrative detention of up to 12 hours, extendable to 24, was regulated to determine migration status (Fifteenth Final Complementary Provision). That detention has been contested; we do not know whether it is applied today as published.

Ley 32192 added article 73.4 (the police may verify your identity without a court order), article 15-A (a procedure to identify someone without a document) and the expulsion ground for failing to identify yourself.

What to do

Know the rule, use the official channel, and get a lawyer if the sanction is compulsory departure or expulsion. Do not sign or declare anything you do not understand. If the problem is Migraciones’ treatment or delay — not the sanction itself — Migraciones’ libro de reclamaciones and the Defensoría del Pueblo are the channels. We say no more than that because in immigration matters a wrong piece of general advice costs years of re-entry ban.

What if you simply don’t pay the fine?

This page covers the amounts and violations. What happens afterward — whether the fine expires, or blocks your exit from the country or renewal of your migratory status — is covered separately in what happens if you don’t pay a Migraciones fine?.

How to file

  1. Check your status and request the official fine calculationDo not pay figures quoted to you verbally. Ask Migraciones through its digital mesa de partes for your fine calculation and the legal basis applied. Keep the registration number.
  2. If you are notified of a sanction procedure, read the resolution and note the deadlinesYou have five business days to file your written defence, counted from the day after you are notified that the sanctioning procedure has started (article 209.1 of the regulation, as worded by Decreto Supremo 011-2024-IN); with a substantiated reason you can ask for more time. Sanctions are formalised by resolution (articles 64 to 66). Write down the notification date — deadlines run from there.
  3. If it is salida obligatoria or expulsión, get a lawyer before you sign or declare anythingSanctions are executed immediately and carry a re-entry ban of up to 5 or up to 15 years. This is not something to handle alone. If you are an asylum seeker or refugee, say so: article 58.2 refers to the asylum and refugee rules.
  4. If Migraciones mistreats you or does not respond, use its libro de reclamaciones and the DefensoríaMigraciones' complaints book is for the service itself (delays, mistreatment, contradictory information). The Defensoría del Pueblo takes complaints from anyone, free and without a lawyer.

What the law already gives you, and what a firm does

You can do this yourself

  • Check your status and ask for the official calculation of the fine.
  • Read the resolution and its deadlines if you are notified of a sanction procedure.
  • Use Migraciones' complaints book and the Defensoría if you get no answer.

Here a lawyer is worth it

If the sanction is mandatory departure or expulsion: get a lawyer before you sign or make a statement.

A law firm charges to run the whole procedure and represent you, and that is worth it in the cases above. For the rest, the law is already written and this page cites it. Need a lawyer?

What people fail to ask in time

During a procedure you are asked to leave your carné de extranjería. Do you know whether it can be kept?

What most people believe — and what the law says

The belief

If I overstay, I get deported.

The law

Overstaying is a ground for a fine (article 56). It becomes a ground for salida obligatoria if you are irregular through overstay and have not applied to regularise (article 57). Expulsion (article 58) has its own grounds: false documents, reoffending after a compulsory departure, ignoring one, entering without immigration control, acts against public order, a court order and — since December 2024 — failing to identify yourself to the authorities.

The belief

Nobody knows what the fine is; it depends on the officer.

The law

Article 190 of the regulation sets five grounds with their percentage of the UIT. The «table» Migraciones approves by resolution only publicises those same amounts. The one thing not in the regulation is the daily aggravating factor in sub-paragraph (d), which Migraciones sets separately.

The belief

Expired residence is fined at 1% of the UIT per day.

The law

That 1% is sub-paragraph (c) and it is per MONTH without updating your carné de extranjería. Not requesting a residence extension is sub-paragraph (d): a 0.67% base plus a daily aggravating factor. Two different infractions.

The belief

My children can be fined or expelled too.

The law

Article 53.3 says it flatly: «En ningún caso MIGRACIONES aplica sanciones a niñas, niños y adolescentes» (in no case does MIGRACIONES apply sanctions to children and adolescents). Article 66 also keeps minors and persons with absolute incapacity out of the procedure.

The belief

I'll pay the outstanding fine when I come back.

The law

Since DL 1582, article 48 allows entry to Peru to be refused if you have not paid a fine imposed in an immigration sanction procedure. An unpaid fine follows you to the border.

The belief

The police can't ask for my documents on the street without a warrant.

The law

Ley 32192 added article 73.4: the Policía Nacional may verify a foreigner's identity without a court order. And failing to identify yourself to the competent authority is now a ground for expulsion (58.1(j)).

Frequently asked questions

If I overstayed my permitted stay by 10 days, how much would I owe roughly?

Overstaying is charged at 0.1% of the UIT per day, so 10 days works out to 1% of the UIT. With the 2026 UIT, that's about S/ 5.50 a day, so 10 days would be roughly S/ 55.00.

Can the hotel I'm staying at fine me if it doesn't record my information?

No, that fine belongs to the hotel, not you. Article 192 of the regulation, as worded by Decreto Supremo 011-2024-IN, sanctions the legal entity providing the lodging service with 1 UIT for not asking for your travel or identity documents, 1 UIT for lodging you without recording your nationality, date of birth, full name and document number, and 2 UIT for not sending that record or information to Migraciones.

Which UIT value is used to calculate my Migraciones fine — today's, or the one from the year the infraction happened?

The UIT in force on the day the infraction was committed is used, not the day you pay. If you overstayed in 2024, for example, the 2024 UIT applies even if you pay later.

If I pay the fine, does that mean I'm automatically regularised?

It's not automatic. Article 188.3 says that once the fine is paid, you can start the procedure to put your migration status in order; paying enables you to begin that process, it doesn't resolve your status by itself.
