Can you transfer your plane ticket to someone else in Peru? When it's free and how it differs from postponing

Short answer

Yes. Since Ley 32325, the ticket holder can endorse or transfer an air ticket to another person up to 24 hours before the flight time, at no cost, as long as the contract conditions stay the same, and the airline issues a new ticket in that person's name free of charge. Postponing the flight is a different thing with different rules.

What we read and what we did notLey 32325 was read in the official El Peruano edition of 9 May 2025 (Normas Legales, pp. 6-7); article 66.7 of Ley 29571, in the Third Official Edition of the Consumer Code (Minjus); and D.S. 007-2026-MTC, on gob.pe. On 11 October 2026 we checked the MTC's official list of supreme decrees (from 2016 to D.S. 018-2026-MTC of 15 September 2026) and found none adapting the Ley 27261 regulation to Ley 32325. We also did not verify how Ley 27261 applies to airlines operating international flights.

What Ley 32325 allows

Ley 32325 was published in El Peruano on 9 May 2025. Congress passed it «por insistencia», overriding the Executive’s objection. It has no waiting period before taking effect: it has been in force since 10 May 2025, the day after publication.

The law adds two paragraphs to article 101 of Ley 27261, Peru’s Civil Aviation Law:

  • 101.4. «El billete de pasaje puede ser endosado o transferido por su titular a otra persona hasta veinticuatro horas antes de la hora cierta de la realización del vuelo respectivo, sin costo alguno, siempre que las condiciones del contrato de transporte aéreo se mantengan iguales, siendo obligación del transportador proporcionar los canales digitales de atención y otros.» (The ticket may be endorsed or transferred by its holder to another person up to twenty-four hours before the set time of the flight, at no cost, provided the conditions of the air transport contract stay the same; the carrier must provide digital service channels and others.)
  • 101.5. «El endoso genera la emisión de un nuevo billete a nombre del endosatario y su emisión es gratuita.» (Endorsement results in a new ticket being issued in the name of the new passenger, and issuing it is free.)

In plain terms: if you bought the ticket and can’t fly, you can pass it to someone else. You, as the holder, make the request. It has to be up to 24 hours before the flight time. They can’t charge you, either for the endorsement or for the new ticket. And the airline has to give you digital channels to do it.

The condition is that nothing else in the contract changes: the conditions of the air transport contract must stay the same.

Endorsing is not postponing

They are two different things, under different rules.

Article 66.7 of the Consumer Code says that, in domestic transport of any kind, consumers can endorse or transfer the service to another consumer «plenamente identificado» (fully identified) or postpone it «en las mismas condiciones pactadas». So for domestic flights it also mentions endorsement. Ley 32325, published in 2025, says for air tickets that endorsement is «sin costo alguno» and that the new ticket is issued free.

Ley 32325 talks about endorsement or transfer. It doesn’t govern postponement.

What if the flight is international?

The text of Ley 32325 doesn’t limit endorsement to domestic flights: it speaks of the «billete de pasaje» (the ticket) without distinguishing. But we did not verify how Ley 27261 applies to airlines operating international flights. So we can’t tell you an airline is bound to transfer an international ticket for free.

What is clear: article 66.7 of the Consumer Code, the postponement rule, covers domestic transport only. This page doesn’t cover what governs postponing an international flight.

If the airline refuses

Ley 32325 also added two paragraphs to article 125 of Ley 27261.

Under 125.5, if the airline «se niegue u omita endosar el contrato de transporte aéreo cuando así lo solicite el titular» (refuses or fails to endorse the air transport contract when the holder asks), within the time and conditions of paragraphs 101.4 and 101.5, «salvo caso fortuito o fuerza mayor, la autoridad aeronáutica civil procederá a aplicar la sanción correspondiente, de acuerdo con la infracción señalada en el reglamento, o la penalidad establecida en la tabla de multas aprobada conforme a las facultades indicadas en el artículo 158» (except in an act of God or force majeure, the civil aviation authority will apply the corresponding sanction, according to the infraction set out in the regulation, or the penalty in the fines table approved under the powers in article 158).

Paragraph 125.6 adds: «En todos los casos, el pasajero tendrá derecho a accionar por los daños y perjuicios.» (In all cases, the passenger has the right to sue for damages.)

Two things worth noting. The exception is an act of God or force majeure. And the sanction depends on what the regulation or the fines table says, which is the next point.

The missing regulation

Ley 32325 ordered the Executive to adapt the Regulation of Ley 27261 (D.S. 050-2001-MTC) «en un plazo de treinta días hábiles contados a partir de su entrada en vigor» (within thirty business days of its entry into force). That deadline expired in 2025.

As of 11 October 2026, we found no decree on the MTC’s official list of supreme decrees adapting the regulation to Ley 32325. The only 2025-2026 decree amending that regulation is D.S. 007-2026-MTC, published 5 March 2026. It deals with how the ticket price is shown (net value, taxes, fees and charges, and the payment methods for items not included). It has nothing to do with endorsement.

What this means for you:

  • Your right to transfer is in the law. Article 101.4 doesn’t depend on the regulation.
  • The sanction is what’s in doubt. Without the adapted regulation, it isn’t clear which infraction and fine the civil aviation authority would use to sanction a refusal.

How to ask for the transfer

  1. Check your flight time and count back: the request must be made up to 24 hours before.
  2. Have the full name and ID document of the person who will fly, exactly as they appear on the document they will travel with.
  3. Ask in writing, through the airline’s digital channels. Ask only for the change of passenger. If you also want to change something about the flight, ask first: free endorsement requires the contract conditions to stay the same.
  4. Keep proof: a screenshot of the request with date and time, the case number, the reply and the new ticket.

A text in Spanish you can use, with an English version below it:

Soy titular del billete [código de reserva / número de billete], vuelo [número] del [fecha] a las [hora], [origen]-[destino].

Solicito endosar este billete a [nombre completo], [tipo y número de documento], sin cambiar ninguna otra condición del contrato, conforme a los párrafos 101.4 y 101.5 de la Ley 27261, incorporados por la Ley 32325. Pido la emisión gratuita del nuevo billete a su nombre.

Hago esta solicitud con más de 24 horas de anticipación a la hora del vuelo.

(I am the holder of ticket [booking code / ticket number], flight [number] on [date] at [time], [origin]-[destination]. I request that this ticket be endorsed to [full name], [ID type and number], without changing any other condition of the contract, under paragraphs 101.4 and 101.5 of Ley 27261, added by Ley 32325. I ask for the new ticket in their name to be issued free of charge. I am making this request more than 24 hours before the flight time.)

Where to complain

If the airline refuses, doesn’t answer or charges you:

  1. The airline’s libro de reclamaciones. Attach your request and their reply. If you’re at the airport, see also where to complain at a Peruvian airport.
  2. Indecopi. It’s the consumer authority and handles air passenger complaints: Reclama Virtual to conciliate, or a denuncia if you want a sanction. The step by step is in how to file a complaint with Indecopi.
  3. The civil aviation authority (the MTC). Ley 32325 gives it the power to sanction a refusal to endorse. We found no MTC complaint channel specific to this.

If the refusal caused you a loss, Ley 32325 gives you the right to claim damages.

How to file

  1. Check how long until the flightThe request must be made up to 24 hours before the flight time. With less time left, Ley 32325 no longer covers you.
  2. Have the new passenger's details readyFull name and ID document number, exactly as they appear on the document they will travel with.
  3. Ask for the endorsement in writingUse the airline's digital channels (website, app, email or chat). Ask only for the change of passenger, without touching the date or route, and cite paragraphs 101.4 and 101.5 of Ley 27261.
  4. Keep proofA screenshot of the request with date and time, the case number, the airline's reply and the new ticket issued.
  5. If they refuse or charge you, complainFirst in the airline's Libro de Reclamaciones. If it isn't resolved, at Indecopi: Reclama Virtual to conciliate, or a denuncia if you want a sanction.

Possible changes ahead

None of this is law in force yet. What this page explains is what applies today; this is what could change it.

Rule still to be issued

Adaptation of the Ley 27261 Regulation (D.S. N.º 050-2001-MTC) to Ley 32325

Where it stands
The Sole Final Complementary Provision of Ley 32325 ordered the Executive to adapt the regulation within thirty business days of the law's entry into force (10 May 2025). As of 11 October 2026, no adapting decree appears on the MTC's official list of supreme decrees. The only 2025-2026 decree amending the regulation is D.S. 007-2026-MTC, on how the ticket price is displayed, and it does not deal with endorsement.
What it would change
The adapted regulation should set which infraction and which fine the civil aviation authority applies to an airline that refuses or fails to endorse a ticket. Today Ley 32325 refers to the infraction in the regulation or to the fines table, and we did not find that adaptation.
How it would take effect
Publication of a supreme decree by the Ministry of Transport and Communications (MTC) in the official gazette El Peruano.
When
No date: the 30-business-day legal deadline expired in 2025

What most people believe — and what the law says

The belief

Putting the ticket in someone else's name costs the same as a fare change.

The law

Endorsement is «sin costo alguno» (at no cost) if you ask up to 24 hours before the flight and the contract conditions stay the same (art. 101.4 of Ley 27261). The new ticket in the other person's name is issued free (art. 101.5).

The belief

Endorsing and postponing are the same thing.

The law

Endorsing changes the passenger: Ley 32325 governs it and it's free. Postponing changes the date: for domestic transport, article 66.7 of the Consumer Code governs it, and you pay only the real cost of issuing the new ticket.

The belief

I can transfer the ticket right up to boarding.

The law

The limit is «veinticuatro horas antes de la hora cierta de la realización del vuelo» (twenty-four hours before the set time of the flight). If you ask later, Ley 32325 no longer covers you.

The belief

Without the regulation, the law doesn't count.

The law

Ley 32325 has been in force since 10 May 2025, and article 101.4 does not refer to the regulation. What refers to the regulation is the sanction for refusing (art. 125.5), and we did not find that adaptation.

Frequently asked questions

Can I transfer a ticket for an international flight?

The text of Ley 32325 does not limit endorsement to domestic flights. We did not verify how Ley 27261 applies to airlines operating international flights, so we can't tell you the airline is bound in that case.

What details do I need from the other person?

Their full name and ID document number, exactly as they appear on the document they will travel with. For domestic transport, article 66.7 of the Consumer Code speaks of another consumer «plenamente identificado» (fully identified).

Can I change the date at the same time?

Free endorsement requires that «las condiciones del contrato de transporte aéreo se mantengan iguales» (the air transport contract conditions stay the same). Our reading is that changing the date is no longer just an endorsement: on domestic flights, postponing is governed by article 66.7 of the Consumer Code.

What if the airline charges me for the transfer or doesn't answer?

Ask for the endorsement in writing and keep the reply. If they charge you or refuse, file a complaint in the airline's Libro de Reclamaciones and, if it isn't resolved, go to Indecopi. Ley 32325 also gives you the right to claim damages.
