Indecopi fines Pedidos Ya for adding a S/3.90 tip by default in its app

Indecopi fined Delivery Hero Perú S.A.C., the company that runs the Pedidos Ya app, 3.78 UIT. Indecopi’s press release of 22 July 2026 does not give the amount in soles; at the 2026 UIT (S/5,500), it comes to S/20,790 (3.78 × 5,500).

According to Indecopi, Consumer Protection Commission No. 2 found, on second and final administrative instance, that the app automatically added a S/3.90 tip to the final order amount without the consumer’s express consent. Anyone who did not want to pay it had to remove it by hand. Indecopi described this design as a “dark pattern”: it relies on user inertia and interferes with the user’s decision, even though the amount could be changed or removed before paying.

Indecopi said that delivery apps and other e-commerce platforms cannot set charges by default.

As a corrective measure, the Commission ordered Pedidos Ya to change its app within 15 business days at most. The “Propina para tu rider” (tip for your rider) section must let each user type in the amount they want to give, with no pre-selected options or default values.
