Can a delivery app in Peru pre-select a tip for you by default?
No. A tip that comes ticked by default is a coercive commercial method under article 56.1(b) of the Consumer Code and collides with the information duty in article 2.2. Indecopi has sanctioned both Rappi and PedidosYa for it: the first was ordered to ask you whether you want to tip, the second to strip every pre-selected option out of the app.

What the statute says
The Consumer Code has no written rule specifically about tips in apps. What it has are two general rules that fit this case exactly.
Article 56.1(b) — coercive commercial methods.
Article 2.2 — information duty. The information you are given «debe ser veraz, suficiente, de fácil comprensión, apropiada, oportuna y fácilmente accesible».
A tip that appears already selected, is added to the total, and can only be removed by hunting for a barely visible button, collides with both. It is a payment you did not request (56.1(b)), and the way to remove it is not easily accessible (2.2). Your silence — not having found and removed it — is not acceptance.
What Indecopi decided
Two cases, both published by Indecopi itself. The full text of the decisions lives in Indecopi’s resolutions search, which requires a token-bearing session and cannot be linked to directly; what follows is what the institution reported officially about each.
Rappi — Resolución 1235-2024/SPC-INDECOPI, 6 May 2024. The Sala Especializada en Protección al Consumidor confirmed, in second and final instance, Rappi S.A.C.’s administrative liability for setting a tip to the rider in advance: a coercive commercial method under article 56.1(b). As a corrective order it required the company «que modifique su plataforma digital para que someta a consulta del consumidor, de manera clara y en términos sencillos, si este desea o no abonar un monto por concepto de propina». That upheld Resolución 0043-2023/CC3, the first-instance decision. Indecopi’s official release states no fine amount.
The corrective order is the more concrete of the two: within 15 business days, the «Propina para tu rider» section must let «cada usuario ingrese manualmente el monto que desee otorgar, sin opciones preseleccionadas ni valores predeterminados».
What matters is not the fine. It is the corrective order: it defines what a lawful tip looks like in an app. No amount set in advance, and the choice yours.
Tip, recargo al consumo and “service fee”
Three things that can appear together in an app should not be confused:
| Item | Can it be pre-selected? | Basis |
|---|---|---|
| Tip | No: no amount and no option ticked in advance; the choice is yours | Art. 56.1(b) |
| Recargo al consumo (restaurants) | May be charged if disclosed beforehand; has its own rule | Art. 5.3 and a special rule |
| “Service fee” or “platform fee” | Only if included in the total price shown before you confirm | Arts. 2.2 and 4 |
There is a separate page on the recargo al consumo. What matters here is that a tip is a gift: there is no basis for charging it unless you add it.
What to do
- Screenshot of the payment screen with the tip selected and no visible option.
- Proof of the charge.
- Written complaint to the app, asking for a refund.
- Indecopi’s Reclama Virtual if they do not answer.
- A denuncia through the Mesa de Partes if you want the practice sanctioned.
If you run a platform
If you operate an app or a payment flow with tipping: no amount and no option ticked in advance, manual entry of the figure, and a clear, plainly worded question about whether the consumer wants to tip. That is exactly what Indecopi ordered Rappi in 2024 and PedidosYa in 2026. Copying the corrective order is cheaper than receiving it.
How to file
- Check the order summary before confirmingLook for the tip line. If it shows an amount and you cannot find how to set it to zero on the same screen, take a screenshot: that is your evidence the option was not accessible.
- If you were charged, keep the proofThe order detail in the app and the charge on your card show the tip amount you did not ask for.
- Complain to the app first, in writingPlatforms keep a virtual libro de reclamaciones. Describe it as a pre-selected tip with no visible way to remove it, and ask for a refund.
- No answer? Indecopi's Reclama VirtualFree, and aimed at conciliation. If you want Indecopi to sanction the practice, file a denuncia through the virtual Mesa de Partes.
- To seek a sanctionFile a denuncia through Indecopi's virtual Mesa de Partes, attaching screenshots of the payment screen and the receipt.

What people fail to ask in time
The charge came from an app, not a shop: where does its complaints book live?
Find out before it matters →What most people believe — and what the law says
The tip in the app is voluntary, so it does not matter that it comes pre-ticked.
Precisely because it is voluntary it cannot come pre-ticked. A payment you did not request, charged unless you find and remove it, is an unagreed obligation: article 56.1(b) calls that a coercive commercial method.
If I did not remove it before paying, I accepted it.
The same article says «en ningún caso puede interpretarse el silencio del consumidor como aceptación» of unrequested payments. Not removing something hidden is not saying yes.
The app says the tip goes entirely to the rider, so it has informed you.
The information duty in article 2.2 requires timely, easily accessible information about what you are going to pay. Where the money goes does not replace a clear notice that there is an optional charge you can leave at zero.
Indecopi has never gone after the apps for this.
It has, twice. In 2024 the Sala Especializada en Protección al Consumidor confirmed Rappi's liability and ordered it to ask the consumer whether they want to pay a tip. In 2026 the Comisión de Protección al Consumidor N.º 2 fined PedidosYa 3.78 UIT and ordered the app left «sin opciones preseleccionadas ni valores predeterminados».
Frequently asked questions
What if the app doesn't refund the tip after I complain to it directly?
Go to Indecopi's Reclama Virtual, which is free and aims at a conciliation with the platform. If you also want the practice sanctioned, file a denuncia through the virtual Mesa de Partes, attaching your screenshots and the receipt.
What's the difference between a pre-selected tip and the recargo al consumo charged at restaurants?
The recargo al consumo can be charged if disclosed beforehand, since it has its own rule. A tip, by contrast, can never come pre-ticked: because it is a gift, article 56.1(b) requires the decision to always be yours.
What sanction did Indecopi impose on PedidosYa for the default tip?
A fine of 3.78 UIT under Resolución Final 2263-2026/CC2, plus a corrective order: within 15 business days it had to remove every pre-selected option or default value for the tip from the app.
What should I keep as proof if the app charged me a tip I didn't choose?
A screenshot of the payment screen showing the tip already selected, plus proof of the charge on your card or in the order detail. That supports both a complaint to the app and a denuncia before Indecopi.
