Freedom to unionize: a right every worker already has
The right to form and join a union is recognized for every worker under Peru’s private-sector labor regime, with no need for the employer’s prior authorization. Affiliation is free and voluntary: an employer cannot condition your job on joining, not joining, or leaving a union, and neither the State nor the employer may interfere in creating, running, or funding whatever union the workers decide to form.
This general protection — freedom to unionize — is different from fuero sindical, explained below. Confusing the two is the most common misunderstanding about this topic.
How many workers it takes to form a union
Under the TUO de la Ley de Relaciones Colectivas de Trabajo, the minimum number of members depends on the type of union:
- Company-level union (sindicato de empresa, workers of one employer): minimum 20 workers.
- Activity, guild, or mixed-trades unions: minimum 50 workers.
If your workplace doesn’t reach the minimum needed to form a union, the law still gives you an alternative: workers can elect two (2) delegates to represent them before the employer and the Labor Authority. That election must be reported within the following 5 business days.
To be a union member you must be a worker of the company, activity, profession, or trade the union covers; not be part of management or a position of trust (unless the union’s own bylaws expressly allow it); and not already belong to another union in the same scope. You can join a union even during your probationary period.
What fuero sindical actually is
Fuero sindical is a distinct, more specific protection than freedom to unionize: it guarantees certain workers cannot be dismissed or transferred to another location of the same company without a duly proven just cause, or without their acceptance when the transfer would actually stop them from continuing to hold their union role.
The difference matters: every worker is protected against being fired for the fact of joining or taking part in union activity (that’s a null dismissal, explained below). But fuero sindical goes further — it requires the employer to prove a just cause even to transfer you — and it does not reach every union member, only the specific roles the law lists.
Who fuero sindical protects
Under Article 31 of the TUO de la LRCT, fuero sindical protects:
- Members of unions still being formed, from the moment the registration request is filed until 3 months afterward.
- Members of the governing board of unions, federations, and confederations, and delegates of union sections.
- Delegates elected when the minimum to form a union isn’t reached, and representatives to the bargaining commission.
- Candidates for officer or delegate positions, starting 30 calendar days before the election and running until 30 calendar days after it concludes — protection begins before you’re even elected.
- Members of the bargaining commission for a list of demands (pliego de reclamos), until 3 months after the process concludes.
An ordinary member with none of these roles does not have fuero sindical — though they remain protected, like any worker, against a dismissal motivated by their union affiliation.
How many officers can actually be protected — the law caps it
Not every officer on a union’s governing board is automatically covered: the law sets a ceiling. Absent a different agreement in a collective bargaining agreement, the cap for a first-tier union is:
- 3 officers for a union with up to 50 members.
- +1 additional officer for every 50 further members.
- A ceiling of 12 officers, no matter how many members the union has.
That number can only be raised through a collective bargaining agreement between the parties — never by a unilateral administrative rule or decision.
Union leave and permits
Absent a collective bargaining agreement that says otherwise, the employer must grant union officers leave to attend events they’re required to attend, up to a limit of 30 calendar days per calendar year, per officer. Time beyond that limit counts as unpaid leave, unless your workplace has a more favorable custom or agreement.
What happens if a protected union officer or delegate is dismissed
Dismissing a worker for their union affiliation or participation in union activities is, by law, a null dismissal (despido nulo) — a distinct category with stronger consequences than an ordinary unfair dismissal. That applies with even more force when the person dismissed had fuero sindical and the employer failed to prove a just cause.
If a judge rules the null-dismissal claim well-founded:
- The worker is entitled to be reinstated to their job, not just paid. Only if the worker themselves prefers it, at the point of enforcing the judgment, can they choose compensation instead.
- The judge orders payment of the wages the worker missed since the date of the dismissal (deducting any procedural delays not attributable to the parties), plus the corresponding CTS deposit.
How much time you have to file a claim
The deadline to file a null-dismissal claim — the same deadline that applies to unfair dismissal and to workplace hostility claims — expires 30 calendar days after the dismissal or unjustified transfer took place. Once that window closes, you lose the ability to claim through this route, so it’s worth acting quickly rather than waiting to see what happens.
What to do if this is happening to you
If you’re a union officer, delegate, or candidate and your employer dismissed or transferred you without a duly proven just cause, gather the evidence of your union role (credential, election minutes, notices sent to the employer and the Labor Authority) and consider filing a null-dismissal claim within the 30-calendar-day deadline. Being a union member already gives me fuero sindical.
No. Union affiliation is protected against retaliation for every worker — firing you for joining is a null dismissal — but fuero sindical, the reinforced protection against dismissal or transfer without a proven cause, only covers officers, delegates, candidates, and members of bargaining commissions or of unions still being formed.
Every officer on a union's board has fuero sindical, with no cap on numbers.
The law caps how many officers are protected: at most 3 in a union with up to 50 members, adding one more officer for every additional 50 members, up to a ceiling of 12. That number can only be raised through a collective bargaining agreement, never by an administrative decision.

Do I need my employer's permission to join a union?
No. The right to unionize is exercised without prior authorization (Art. 2 of the TUO de la LRCT), and affiliation is free and voluntary: your employer cannot condition your job on joining, not joining, or leaving a union.
How many workers does it take to form a union at my company?
Twenty (20) workers for a company-level union (sindicato de empresa), or fifty (50) for other types (activity, guild, or mixed-trades unions). If your workplace doesn't reach that number, the law still lets workers elect two delegates to represent them before the employer and the Labor Authority.
I'm a candidate for a union leadership position — do I already have fuero sindical?
Yes. Protection for candidates for officer or delegate positions starts 30 calendar days before the election and runs until 30 calendar days after it concludes — before you've even been elected.
Can the company transfer me to another location even though I have fuero sindical?
Only with a duly proven just cause. The one exception is a transfer that wouldn't stop you from continuing to carry out your union role, in which case your prior acceptance isn't required.
If I'm fired for being a union officer, can I only claim money?
No. That is a null dismissal (despido nulo), and the law lets you demand reinstatement to your job — not just a payout — plus the wages you didn't receive since the dismissal. Only if you yourself prefer it, at the point of enforcing the judgment, can you choose compensation instead of returning to the job.
