My child is seriously ill or has cancer: how much leave does Peruvian law give me, and who pays?
If your child has a serious or terminal illness or a serious accident, you get up to seven calendar days of paid leave, plus up to thirty more charged to your vacation. If your child under 18 has cancer, the law grants up to one year of paid leave: the employer pays the first 21 days and EsSalud the rest.

What the law says
Ley 30012 gives leave to a worker whose close family member is seriously ill or injured. In 2020, Ley 31041 rewrote its articles 1 and 2. This is the current text of article 1:
“La presente ley tiene por objeto establecer el derecho del trabajador de la actividad pública y privada a gozar de licencia en los casos de tener un hijo, padre o madre, cónyuge o conviviente, o persona bajo su curatela o tutela, enfermo diagnosticado en estado grave o terminal, o que sufra accidente que ponga en serio riesgo su vida, con el objeto de asistirlo.”
(Public and private sector workers have the right to leave to care for a child, parent, spouse or partner, or a person under their guardianship, who is diagnosed as seriously or terminally ill or suffers an accident that seriously endangers their life.)
The regulation (D.S. 008-2017-TR) adds that children count “independientemente de su edad” (regardless of age), and that the right covers every public or private worker “independientemente del régimen laboral al que pertenezcan” (whatever their employment regime).
How many days, and how they are paid
The leave has three tiers. Article 2 of the law says:
“La licencia a que se refiere el artículo 1 es otorgada por el plazo máximo de siete días calendario, con goce de haber. De ser necesario más días de licencia, estos son concedidos por un lapso adicional no mayor de treinta días, a cuenta del derecho vacacional.”
(The leave lasts up to seven calendar days, with pay. If more days are needed, up to thirty additional days are granted, charged to your vacation entitlement.)

The seven days run consecutively, but the regulation lets you split them “por acuerdo de partes o disposición del empleador” (by agreement or at the employer’s decision). The third tier only exists if your employer agrees: the law says “previo acuerdo” (with prior agreement).
If your child has cancer
Ley 31041 added a third paragraph to article 2:
“De manera excepcional y única se otorga licencia con goce de haber por el periodo no mayor a un año y de acuerdo con las necesidades del trabajador cuyo hijo, niño o adolescente menor de 18 años sea diagnosticado de cáncer por el médico especialista, el cual deberá ser cubierto los primeros veintiún (21) días por el empleador y el tiempo restante por EsSalud”
(Exceptionally, a worker whose child under 18 is diagnosed with cancer by a specialist gets paid leave of up to one year, according to their needs. The employer covers the first 21 days and EsSalud the rest.)
Three conditions: your child is under 18, the diagnosis is cancer, and a specialist made it. The leave lasts up to a year, depending on your needs.
There is a gap here. The Ley 30012 regulation dates from 2017 and does not cover this leave. The Ley 31041 regulation (D.S. 024-2021-SA) does not either. We did not find in El Peruano any rule on how the EsSalud portion is processed. The right is in the law, but confirm with EsSalud and your employer how it is paid before you plan your finances around it.
The same law also creates a separate cancer subsidy. Article 6 says health insurers (IAFAS), public or private, “otorgan un subsidio económico equivalente a dos remuneraciones mínimas vitales (RMV) al trabajador por familia” (pay a subsidy equal to two minimum monthly wages per family) when a child under 18 is diagnosed with cancer, for as long as hospital treatment lasts. The regulation told Minsa to set rules for this subsidy; we did not find them.
What counts as “serious”
Not every illness qualifies. The regulation defines:
“Enfermedad grave: es aquella cuyo desarrollo pone en riesgo inminente la vida del paciente y requiere cuidado médico directo, continuo y permanente; siendo necesaria la hospitalización.”
(A serious illness is one that puts the patient’s life at imminent risk and needs direct, continuous and permanent medical care, with hospitalization.)
A terminal illness requires “un pronóstico de vida inferior a seis (6) meses” (a life expectancy under six months). A serious accident must put life “en serio e inminente riesgo” (at serious and imminent risk), and also requires hospitalization. The medical certificate is what classifies your case.
How to request it
You have 48 hours from when the event happens or you learn of it. The regulation asks for three things: a written notice or email with the start date, length and reason; a document proving your relationship to your child; and the medical certificate. If you give no start date, the leave starts the calendar day after your notice.
If an insurmountable obstacle stops you from gathering the documents in time, say so in the notice as a sworn statement (declaración jurada) and hand them in within 24 hours of getting them.
If the certificate then does not classify the case as serious, you must return to work by the next working day at the latest. The time you missed cannot be docked or treated as misconduct, as long as your child was hospitalized and you make up those hours.
What your employer can and cannot do
Your employer can check that you use the leave for its purpose. The regulation says using it for other ends “puede ser calificado como una falta disciplinaria de carácter grave” (can be treated as serious misconduct). We found nothing in the law or regulation allowing an employer to refuse the seven days if you meet the requirements. If your company already offers something better, by its own decision or a collective agreement, that benefit stays (Ley 30012, art. 4).

What this page does not cover
We do not cover paternity leave or a newborn with a congenital illness, which have their own rule: see paternity leave and breastfeeding break. We did not review the EsSalud procedure for the cancer leave or the cancer subsidy, because we did not find the rule that regulates them. We also do not cover the specific rules of each public-sector regime, or sick leave when you are the one who is ill.
How to file
- Get the medical certificateThe doctor must state whether your child has a serious illness, a terminal illness or a serious accident. For the cancer leave, the law requires a diagnosis by a specialist.
- Notify your employer in writing within 48 hoursSend a letter or email requesting the leave, with the start date, how long it will last and the reason. Attach proof that it is your child (birth certificate or DNI) and the medical certificate. Keep a copy and proof of sending.
- If you need more days, request them with the certificateFor the extension charged to your vacation, send another notice explaining why and attach the medical certificate. If you then need more time, sign the overtime-compensation agreement first.

If your child has a serious or terminal illness or a serious accident, Ley 30012 gives you up to seven calendar days of paid leave. Those days count as worked for all legal purposes, except for calculating profit sharing (regulation, article 6).
This leave is only for young children.
The regulation defines direct family members as «los hijos, independientemente de su edad» (children, regardless of age). Age matters only for the special cancer leave, which requires a child under 18.
Any illness of my child qualifies.
The regulation defines a serious illness as one that puts life at imminent risk and requires hospitalization. A terminal illness requires a life expectancy of under six months. A cold or a mild illness does not qualify.
If my child has cancer, I only get the same seven days as for any serious illness.
Since Ley 31041, article 2 of Ley 30012 grants paid leave of up to one year if your child under 18 is diagnosed with cancer by a specialist: the employer covers the first 21 days and EsSalud the rest.
Frequently asked questions
Are the seven days paid?
Yes. The law says the leave is «con goce de haber» (with pay), and the regulation says it «es remunerada» (is paid). The regulation adds that these seven days count as worked for all legal purposes, except for calculating profit sharing.
The seven days are over and my child is still seriously ill. What now?
You can ask for up to thirty more days, but they come out of your vacation, in proportion to the vacation entitlement you have accrued. Ask in writing or by email, explain why, and attach the medical certificate. After that, you can agree with your employer on extra periods that you make up later with overtime hours, which are not paid at the overtime premium.
How soon do I have to tell my employer?
Within 48 hours of the accident or illness happening or becoming known to you. Send a written notice or email, a document proving your relationship to your child, and the medical certificate. If an insurmountable obstacle stops you from getting the documents in time, say so in the notice as a sworn statement and hand them in within 24 hours of obtaining them.
Can my employer refuse because I'm on probation or under a special regime?
The regulation says the right belongs to public and private sector workers «independientemente del régimen laboral al que pertenezcan» (whatever their employment regime). We found no probation-period exception in the law or the regulation.
My child has cancer. Who pays for the year of leave?
The law says the employer covers the first 21 days and EsSalud the rest. We did not find in El Peruano the rule setting how EsSalud's payment is processed, so confirm with EsSalud and your employer how it works in your case before relying on that money.
