EsSalud coercive collection in Peru: what it is, who it targets and how to defend yourself
It depends on the debt. Unpaid EsSalud contributions are a tax debt: Sunat collects them under the Tax Code. Non-tax debts, such as the cost of care EsSalud gave to a delinquent employer's workers, EsSalud collects itself under Ley 26979, which lets you ask for suspension and seek judicial review.

Two different collectors behind “EsSalud”
When someone says “EsSalud is collecting from me”, it can mean two different procedures. The key is article 14.2 of Ley 27056, the law that created EsSalud:
“La administración de las aportaciones al Régimen Contributivo de la Seguridad Social en Salud se rige por el Código Tributario, de conformidad con lo dispuesto por la Norma II del Título Preliminar de dicho Código. La facultad de cobranza coactiva de las deudas al ESSALUD que no tengan naturaleza tributaria, se regirá por la Ley de Procedimiento de Ejecución Coactiva, Ley Nº 26979.”

Contributions: Sunat administers them
The Tax Code says so in its Norma II:
“Las aportaciones al Seguro Social de Salud - ESSALUD y a la Oficina de Normalización Previsional - ONP se rigen por las normas de este Código, salvo en aquellos aspectos que por su naturaleza requieran normas especiales, los mismos que serán señalados por Decreto Supremo.”
(EsSalud and ONP contributions are governed by the Tax Code, except where special rules set by supreme decree are needed.)
In 2000, Ley 27334 gave that job to Sunat:
“La Superintendencia Nacional de Administración Tributaria (SUNAT) ejercerá las funciones antes señaladas respecto de las aportaciones al Seguro Social de Salud (ESSALUD) y a la Oficina de Normalización Previsional (ONP) […]”

Sunat’s official guidance on gob.pe confirms it today: “La Sunat recauda los aportes a EsSalud que realizan los empleadores por sus trabajadores cada mes” (Sunat collects the EsSalud contributions employers make for their workers each month). So if your company owes contributions, the notice and any attachment usually come from Sunat’s ejecutor coactivo, under the Tax Code. Ley 27334 also allows Sunat to administer other non-tax EsSalud obligations through agreements; we did not review those agreements.
What EsSalud collects itself
The most common case is an employer that did not pay contributions. The worker does not lose care:
“La falta de pago oportuno de las aportaciones por los afiliados regulares no determina que aquellos dejen de percibir las prestaciones que les correspondan. En tales casos, el ESSALUD, utilizando la vía coactiva, repite contra el empleador o la entidad encargada del pago al pensionista, según corresponda, por las prestaciones otorgadas.”
(Late payment does not stop workers from receiving their benefits; EsSalud recovers the cost of those benefits from the employer, or from whoever pays the pension, through coercive collection.)
That charge is not a contribution but the cost of what EsSalud spent. Read together with article 14.2, it is a non-tax debt and goes through Ley 26979. That is our reading of the two paragraphs together; the law does not say it in one sentence.
The regulation of Ley 27056 adds another case: “ESSALUD ejerce la cobranza coactiva de las multas” (EsSalud collects fines coercively; article 31 of D.S. 002-99-TR). The same article requires anyone who used unlawful means to obtain benefits without being insured to “reembolsar a ESSALUD el costo de los servicios recibidos” (reimburse EsSalud for the cost of the services).
When collection can start (Ley 26979)
It is not enough for EsSalud to say you owe. The debt must be in an administrative act that was notified and is final:
“Se considera Obligación exigible coactivamente a la establecida mediante acto administrativo emitido conforme a ley, debidamente notificado y que no haya sido objeto de recurso impugnatorio alguno en la vía administrativa, dentro de los plazos de ley o en el que hubiere recaído resolución firme confirmando la Obligación.”
(A debt is enforceable when it comes from a lawful, properly notified administrative act that was not appealed in time, or that a final decision confirmed.)
Then the ejecutor serves the Resolución de Ejecución Coactiva and you have seven (7) business days to comply, “bajo apercibimiento de dictarse alguna medida cautelar” (under warning of precautionary measures; article 14.1). Sunat gives the same period when collecting contributions (Tax Code, article 117).
Asking the ejecutor to suspend
Article 16.1 requires EsSalud’s ejecutor to suspend, on its own responsibility, when:
“a) La deuda haya quedado extinguida o la obligación haya sido cumplida; b) La deuda u obligación esté prescrita; c) La acción se siga contra persona distinta al Obligado; d) Se haya omitido la notificación al Obligado, del acto administrativo que sirve de título para la ejecución; e) Se encuentre en trámite o pendiente de vencimiento el plazo para la presentación del recurso administrativo de reconsideración, apelación, revisión o demanda contencioso-administrativa […]”
(The debt is paid; it is time-barred; the wrong person is being pursued; the underlying act was never notified; or an administrative appeal or court claim is pending or still within its filing period.)
Also when an instalment plan was granted (letter g). You can ask for it with evidence, and the ejecutor has a deadline:
“El Ejecutor deberá pronunciarse expresamente sobre lo solicitado, dentro de los ocho (8) días hábiles siguientes. Vencido dicho plazo sin que medie pronunciamiento expreso, el Ejecutor estará obligado a suspender el Procedimiento, cuando el Obligado acredite el silencio administrativo con el cargo de recepción de su solicitud.”
(The ejecutor must decide within eight business days; if it does not, it must suspend once you show the stamped receipt of your request.)
Once suspended, “se procederá al levantamiento de las medidas cautelares que se hubieran trabado” (any attachments are lifted; article 16.5). That is why the dated receipt matters.
Judicial review
Article 23 lets you take the procedure to a judge, but only to review its legality. Since Ley 31370, the claim goes to the Juez Especializado en lo Contencioso Administrativo. You can file once an attachment or other precautionary measure has been ordered, or after the procedure ends, “dentro de un plazo de quince (15) días hábiles de notificada la resolución que pone fin al procedimiento” (within fifteen business days of notice of the resolution that ends it).
On the effect of filing, the current text (as amended by Ley 32035) says:
“La sola presentación de la demanda de revisión judicial suspende automáticamente la tramitación del procedimiento de ejecución coactiva en los casos de actos administrativos que contengan obligaciones de dar o de hacer, a los que hace referencia el literal a) del párrafo 23.1 […]”
(Filing the claim automatically suspends the procedure in the cases under letter a) of 23.1, until the judge rules.)
The regulation adds a practical condition: “es necesario que el interesado lo solicite por escrito ante el respectivo Ejecutor Coactivo, adjuntando copia simple del cargo de presentación de la demanda” (you must ask the ejecutor in writing, attaching a plain copy of the filing receipt; article 9.3, as set by D.S. 245-2024-EF).
If Sunat is collecting, the rules change
Contribution collection is governed by the Tax Code, not Ley 26979, and it is tighter: “Ninguna autoridad ni órgano administrativo, político, ni judicial podrá suspender o concluir el Procedimiento de Cobranza Coactiva en trámite con excepción del Ejecutor Coactivo” (no authority other than the ejecutor can suspend it; article 119). The court route comes at the end: “Sólo después de terminado el Procedimiento de Cobranza Coactiva, el ejecutado podrá interponer recurso de apelación ante la Corte Superior dentro de un plazo de veinte (20) días hábiles” (only after the procedure ends, an appeal to the Corte Superior within twenty business days; article 122). If you are a worker

How to file
- Identify who is collecting and what debt it isRead the Resolución de Ejecución Coactiva: who the ejecutor is (Sunat or EsSalud) and what it is for (contributions, benefits provided, a fine). That decides which rules apply.
- Count the seven business daysFrom notice you have seven (7) business days to comply before precautionary measures can be ordered (Ley 26979, article 14.1; Tax Code, article 117).
- If there is a ground, ask for suspension in writingWhen EsSalud collects under Ley 26979, file your request with evidence: debt paid or time-barred, wrong person, the underlying act never notified, an appeal or claim pending, or an instalment plan granted (article 16). Keep the stamped receipt.
- If assets were attached, consider judicial reviewYou can ask the administrative-law judge to review the legality of the procedure. For the automatic suspension, give the ejecutor a written request with a plain copy of the filing receipt (D.S. 245-2024-EF, article 9.3).

If my company owes EsSalud contributions, EsSalud is the one that seizes my assets.
For contributions, usually not. Ley 27056 says contributions follow the Tax Code, and since Ley 27334 (2000) Sunat administers them. That collection follows Sunat's rules in the Tax Code, not Ley 26979.
If my employer did not pay EsSalud, I cannot get care.
False. Article 14.7 of Ley 27056 says unpaid contributions do not stop the worker from receiving benefits. EsSalud provides the care and then recovers the cost from the employer through coercive collection.
Against coercive collection, the only option is to pay.
When EsSalud collects under Ley 26979, you can ask the ejecutor to suspend if there is a ground in article 16 (debt paid or time-barred, wrong person, no notice, appeal pending, instalment plan granted), and you can ask a judge to review the legality of the procedure (article 23).
Filing for judicial review always stops the attachment.
Not always. The automatic suspension in article 23.3 covers the cases in letter a) of 23.1, where an attachment or other precautionary measure was already ordered, and the regulation requires you to ask the ejecutor in writing, with a copy of the filing receipt.

How do I know whether Sunat or EsSalud is collecting?
Check who signs the Resolución de Ejecución Coactiva and what debt it covers. Monthly contributions for your workers are a tax debt Sunat administers under the Tax Code. The cost of benefits EsSalud provided, an EsSalud fine or another non-tax debt is collected by EsSalud under Ley 26979.
How long do I have to pay before assets are attached?
Both regimes give the same order: seven (7) business days from notice of the Resolución de Ejecución Coactiva, under warning of precautionary measures (Ley 26979, article 14.1; Tax Code, article 117).
What if I ask for suspension and the ejecutor does not answer?
Under Ley 26979, the ejecutor has eight (8) business days to decide. If it does not, it must suspend, as long as you prove the silence with the stamped receipt of your request (article 16.4). Once suspended, the precautionary measures are lifted (article 16.5).
Can I go to court?
Yes. Against EsSalud collection under Ley 26979, you can file a judicial review claim before the specialised administrative-law judge once an attachment has been ordered or, if the procedure has ended, within fifteen (15) business days of notice of the resolution ending it (article 23.1). Against Sunat collection, the Tax Code only allows an appeal to the Corte Superior after the procedure ends, within twenty (20) business days (article 122).
I got care at EsSalud without being insured. Can they charge me?
The regulation of Ley 27056 requires anyone who used unlawful means to obtain benefits without being insured to reimburse the cost of the services, and lets EsSalud collect fines coercively (article 31 of D.S. 002-99-TR). Other charges to uninsured patients are not covered on this page.
