Adoption in Peru: how the administrative procedure before the Dirección General de Adopciones works
Adopting a child or adolescent who has been judicially declared in desprotección familiar and adoptability is an administrative, free-of-charge procedure before the MIMP's Dirección General de Adopciones (DGA) or a regional Unidad de Adopción — not a court case. It has four stages: evaluation, designation, family integration and post-adoption. You are evaluated and declared suitable, the Consejo Nacional de Adopciones approves a designation, an empathy phase and a ten-business-day pre-adoptive placement follow, and only then is the resolution declaring the adoption issued. Spouses, partners in a common-law union with a current notarial declaration, and single people forming a one-parent family may all apply, aged 25 to 62.

What is still unverifiedThe articles cited here were read directly from the official text of Decreto Legislativo N.º 1297 published by MIMP on gob.pe and from Decreto Supremo N.º 001-2018-MIMP published in El Peruano. Three limits to this verification. First: this page does not describe the prior desprotección familiar procedure — the one that ends in the judicial declaration of desprotección familiar and adoptability, and which is what makes a child adoptable — nor the inheritance effects of adoption, which the Civil Code governs. Second: we confirmed that Ley N.º 32017 (10 May 2024) amended articles 30, 41, 55 and 63 of the Decreto Legislativo, which belong to the risk and desprotección procedure, and that Decretos Supremos 006-2022-MIMP and 006-2024-MIMP amended regulation articles outside the adoption title. The clock running against you
5 business days from notice of the designation approved by the Consejo Nacional de Adopciones.This is a procedural deadline: miss it and you lose that route and have to start another.
If you do not state your acceptance within that window, the designation lapses automatically and the family designated as second choice is notified. It is not the only deadline in the procedure: the empathy phase lasts up to 5 business days extendable by 5 more (article 201), and the pre-adoptive placement 10 business days extendable by 5 more (article 203).

First, the rule that no longer applies
Almost everything circulating online about adoption in Peru describes Ley N.° 26981 and its “Oficina de Adopciones”: an application assessed in 15 business days, a Lista de Espera de Adoptantes, an Informe de Empatía in 7 calendar days, a Colocación Familiar of 7 days extendable by 7 more.
None of that is in force. The Sixth Repealing Complementary Provision of Decreto Legislativo N.º 1297 (published 30 December 2016) is explicit: “Deróguese la Ley N° 26981, Ley de Procedimiento Administrativo de Adopción de Menores de Edad Declarados Judicialmente en Abandono.” The decree took effect the day after its regulation, Decreto Supremo N.º 001-2018-MIMP, was published (El Peruano, 10 February 2018), so Ley 26981 stopped governing on 11 February 2018.
Two things people still repeat went with it: the figure of the judicial declaration of abandonment — today it is the judicial declaration of desprotección familiar y adoptabilidad — and the Oficina de Adopciones of the old PROMUDEH, whose role is now played by the Dirección General de Adopciones (DGA) of the Ministry of Women and Vulnerable Populations and its decentralised Unidades de Adopción (UA).
Who can adopt
Article 124 of Decreto Legislativo 1297 allows three situations, and none of them requires being married:
- Spouses.
- Partners in a common-law union with a current notarial declaration.
- People who wish to form a one-parent family — that is, a single person.
There’s a fourth ground almost nobody mentions: before Decreto Legislativo 1297 itself even took effect, Ley N.º 30690 (5 December 2017) added a subsection d): the foster family a child is already living with has a preferential right to adopt them. It’s the same logic enabled from the other side of the procedure by article 96 — also amended by that law — which lets the technical report proposing a desprotección familiar declaration exceptionally recommend direct adoption by that foster family, alongside the declaration of desprotección and adoptability itself.
Article 125 adds the requirements: being between 25 and 62 years old — the upper limit is extended only exceptionally, on grounds justified by the best interests of the child — agreeing to the adoption voluntarily and in writing, and holding the declaration of suitability. Spouses and common-law partners file jointly.
On the other side, article 126 is blunt about who can be adopted: a child or adolescent with a judicial declaration of desprotección familiar and adoptability. That ruling is not obtained in the adoption procedure but in an earlier, separate one, which this page does not cover.
The four stages and their real deadlines
Article 137 splits the procedure into evaluation, designation, family integration and post-adoption. The regulation sets the concrete deadline for each step:

The point no table can resolve: there is no total deadline. The business days above are per step. What has no deadline is the wait in the Registro de Adoptantes until the Consejo Nacional de Adopciones approves a designation, because that stage is not settled first-come-first-served but by compatibility between each child’s needs and each family’s profile (article 191 of the regulation). A suitable family can wait years.
What happens if something goes wrong
The procedure has two distinct breaking points, with distinct consequences.
If you do not accept the designation within the 5 business days, it lapses automatically and the family designated as second choice is notified (article 199). If the empathy report is unfavourable, the designation is set aside and the authority assesses whether the family returns to the waiting list, provided there are justified reasons (article 202). In both cases — and also when the child does not accept — article 196 provides a second chance at designation, subject to a favourable, reasoned report from the DGA or the UA.
If what comes back unfavourable is the pre-adoptive placement report — with the child already living with the family — the consequence is more serious: the DGA revokes the placement, sets aside the designation and closes the adoption procedure, notifying the Unidad de Protección Especial so it can order whatever protective measure fits (article 204). The pre-adoptive placement can end unfavourably even before its deadline runs out.
Why adoption doesn’t go through a judge (but the step before it does)
Adoption is approved by an administrative resolution of the DGA, not by a judgment: that is what article 139 of the Decreto Legislativo says, and it is why the resolution can be appealed within 5 business days (article 144), as in any administrative procedure.
That does not mean no judge is involved anywhere. One is, earlier: the judicial declaration of desprotección familiar and adoptability in article 126 is a court decision, issued in a separate procedure. The administrative track begins precisely when that ruling becomes final and is communicated to the DGA or the UA.
What the 2024 deadline reform actually changed
Ley N.º 32017, of 10 May 2024, was announced as the law setting “new deadlines for risk, desprotección familiar and adoption procedures”. Its sole article is worth reading: it amends articles 30, 41, 55 and 63 of Decreto Legislativo 1297. All four belong to the risk and desprotección familiar procedure — the individual work plan and the duration of provisional protective measures — not to the adoption title. Its effect on adoption is indirect but real: by shortening how long a child can remain under provisional measures, it pushes the definitive decision — family reintegration, or a declaration of desprotección and adoptability — to arrive sooner.
Effects of the adoption
Article 127 leaves no room: adoption is full, indivisible and irrevocable. The child becomes part of the adoptive family as a son or daughter, with all the rights and obligations that carries, and any legal effect of kinship with their blood ascendants or collaterals is extinguished.
In registry terms that means a new birth certificate: RENIEC registers the birth on the strength of the administrative adoption resolution, without stating the adoptive status, and voids the original entry (article 139 of the Decreto Legislativo and article 206 of the regulation).
The whole procedure is free of charge and confidential (article 135). And the adopted person keeps a right that outlives the new certificate: article 145 recognises the right to know their origins, including the identity of their biological parents and their medical history, through an application to the competent MIMP authority.

How to file
- Check you meet the Article 125 requirements before filing anythingBe between 25 and 62, agree to the adoption voluntarily and in writing — jointly if you are married or in a common-law union with a current notarial declaration — and be ready to obtain the declaration of suitability.
- File your application with the DGA or a Unidad de AdopciónA national adoption application is filed with the Dirección General de Adopciones or a Unidad de Adopción; an international one only with the DGA (articles 14 and 167 of the regulation).
- Pass the legal evaluation, then the psychological and social oneThe legal evaluation is resolved within 4 business days; if there are observations you get 10 extendable business days to cure them (article 177). Once past that, the psychological and social evaluation takes up to 30 business days (article 178).
- Obtain the declaration of suitability and enter the Registro de AdoptantesWith all three evaluations favourable, a resolution declares you suitable and enters you in the Registro de Adoptantes. That suitability lasts three renewable years (articles 187 and 188).
- Wait for a designation from the Consejo Nacional de AdopcionesThe interdisciplinary team proposes families for each child declared in desprotección familiar and adoptability, and the Consejo Nacional de Adopciones approves or rejects the proposal (article 136 of the Decreto Legislativo). There is no fixed deadline: it depends on compatibility.
- Accept the designation within 5 business daysIf you don't, the designation lapses automatically and passes to the family designated as second choice (article 199). Once accepted, preparation follows for up to 7 business days, extendable by 5 more.
- Empathy phase and pre-adoptive placementThe empathy phase lasts up to 5 business days, extendable by 5 more, and its report is issued the following day (article 201). If it's favourable, the pre-adoptive placement is granted: 10 business days of living together, extendable by 5 (article 203).
- Receive the adoption resolution and its RENIEC registrationThe placement report is issued within 1 business day and, if favourable, the DGA issues the resolution declaring the adoption within 2 business days (article 204). Once final, RENIEC is instructed to register the new birth certificate, voiding the original (article 139 of the Decreto Legislativo and article 206 of the regulation). The resolution can be appealed within 5 business days (article 144).
- Expect post-adoption follow-upIn national adoptions, the DGA carries out home visits or interviews every six months for three years; in international ones, follow-up lasts four (articles 208 and 209 of the regulation).

Adoption in Peru is governed by Ley N.° 26981 and handled by the Oficina de Adopciones.
Not anymore. The Sixth Repealing Complementary Provision of Decreto Legislativo N.º 1297 expressly repealed Ley N.º 26981, and that repeal took effect when the decree entered into force, the day after its regulation was published (11 February 2018). Today the procedure is run by MIMP's Dirección General de Adopciones, or a regional Unidad de Adopción, under different rules, stages and deadlines.
You adopt a minor who has been «judicially declared abandoned».
That category disappeared with Ley 26981. Article 126 of Decreto Legislativo 1297 now requires a judicial declaration of desprotección familiar and adoptability, which is the outcome of a separate procedure that comes before the adoption one.
Adopting in Peru costs money you have to pay the State.
No. Article 135 of Decreto Legislativo 1297 says the adoption procedure is free of charge and confidential.
Only a married couple can adopt.
Article 124 allows four situations: spouses, partners in a common-law union with a current notarial declaration, people who wish to form a one-parent family (a single person can apply), and — since the 2017 Ley 30690 — the foster family already living with the child, who has a preferential right to adopt them.
There's no age limit for adopting.
Article 125(a) sets a band of twenty-five to sixty-two years. The upper limit can only be extended exceptionally, on duly justified grounds based on the best interests of the child. The regulation adds that for someone already over 58, the declaration of suitability expires at 62 and is not renewable (article 188).
Once you're declared suitable, the adoption is a matter of weeks.
The deadlines the rules set are the ones for each administrative step — 4 business days for the legal evaluation, up to 30 for the psychological and social one, 5 to accept the designation, 10 for the pre-adoptive placement. No rule sets how long a suitable family waits in the Registro de Adoptantes for a designation, because that depends on compatibility with each individual child's needs (article 191 of the regulation).
The child has no say in their own adoption.
Article 138 of the Decreto Legislativo requires their opinion to be sought in the evaluation and family-integration stages, and taken into account in all of them. Article 203 of the regulation repeats the obligation during the pre-adoptive placement, according to their age and maturity, and article 196 sets out what happens if acceptance does not come.
Frequently asked questions
What happens if I don't accept the child's designation within the 5 business days?
The designation automatically lapses, and the family designated as the second choice is notified, under article 199 of the regulation. So it's worth being clear on your decision before that deadline starts running.
Can I appeal if I disagree with the resolution that declares the adoption?
Yes. Article 144 of Decreto Legislativo 1297 gives you 5 business days from notice of the resolution to file an appeal.
Is the process the same if I want to do an international adoption?
Not in terms of where you file: a national adoption application can be filed with the Dirección General de Adopciones or with a regional Unidad de Adopción, but an international adoption application must be filed with the DGA only, under article 167 of the regulation.
Will my adopted child ever be able to know who their biological parents are?
Yes. Article 145 of Decreto Legislativo 1297 recognizes the adopted person's right to know their origins, including the identity of their biological parents and their medical history, through a request filed with MIMP. For children and adolescents, that information can only be withheld if disclosing it would harm their best interests.

Three limits to this verification. First: this page does not describe the prior desprotección familiar procedure — the one that ends in the judicial declaration of desprotección familiar and adoptability, and which is what makes a child adoptable — nor the inheritance effects of adoption, which the Civil Code governs. Second: we confirmed that Ley N.º 32017 (10 May 2024) amended articles 30, 41, 55 and 63 of the Decreto Legislativo, which belong to the risk and desprotección procedure, and that Decretos Supremos 006-2022-MIMP and 006-2024-MIMP amended regulation articles outside the adoption title. We also found and incorporated an earlier amendment we had missed: Ley N.º 30690 (5 December 2017) — before the Decreto Legislativo itself even took effect — added subsection d) to article 124, giving a foster family a preferential right to adopt, and amended articles 96, 123 and 140. We have not exhaustively ruled out every amendment beyond these.
