Indecopi upholds fine against Scotiabank, BBVA and a Chimbote restaurant over unrecognized card charges
In two separate cases, Indecopi upheld on final appeal fines against Scotiabank and a Chimbote restaurant, and against BBVA, for failing to block fraudulent transactions on customers' credit and debit cards.

Indecopi upheld, on final administrative appeal, fines against two financial institutions and a restaurant in Chimbote for allowing unrecognized transactions and charges on customers’ cards, in two separate cases decided by the Specialized Consumer Protection Chamber and by Indecopi’s Regional Office Commission in Chimbote.
In the first case, the fine against Scotiabank Perú S.A.A. and Restaurant Negrita E.I.R.L. was upheld — 2 UIT each (S/ 22,000 total) — after the bank failed to trigger security alerts on an unusual S/ 28,243 transaction and the restaurant skipped verifying the identity of whoever made a S/ 5,980 charge with the same customer’s credit card.
In the second case, a fine of 3.78 UIT (S/ 20,790) against Banco BBVA Perú S.A. was confirmed for not implementing stronger authentication — even though the fraudulent transactions went through mobile banking with a token — against four unrecognized charges on a customer’s debit card.
In both cases, Indecopi also ordered the refund of the amounts wrongly charged, plus procedural costs. Since this is a final administrative decision, the companies can only challenge it in court.
