ARCO request: access, rectification, cancellation or objection to your personal data

We draft your request to the company that holds your personal data to exercise access, rectification, cancellation or objection, with the requirements and deadlines of the Ley 29733 regulation. This is not legal advice or representation. The letter exercises, before the company, the rights you fill in: access, rectification, cancellation or objection (Ley 29733, articles 19, 20 and 22). Under the regulation (D.S. 016-2024-JUS), the company has twenty (20) days for access and ten (10) days for rectification, cancellation or objection, counted from the day after you file (article 69), and may extend them once, by an equal period, if it gives a reason (article 71). Before a private company, exercising these rights is free (article 67.3). Sign it, attach a copy of your ID and keep the proof of delivery with its date: if they do not answer in time or refuse, that is what you need to go to the National Personal Data Protection Authority (article 88), with the complaint to the ANPD. The letter says you attach a copy: the regulation asks you to prove your identity.
It is a requirement of the request (article 64 of the regulation). It can be an email.
Name or legal name. For example, the shop, the clinic, the bank or the collection agency.
For example, "I have been a customer since 2022" or "I was never a customer, but they call me about a debt".
For example, "all of my personal data held in your data banks".
For example, "my address shows as Av. Lima 123; the correct one is Jr. Cusco 456".
The law speaks of data that is inaccurate, incomplete, out of date, or no longer needed for the purpose it was collected for.
The law asks for well-founded, legitimate reasons about your specific personal situation. For example, "I object to my phone number being used for advertising; I never authorised it".
For example, a bill with your correct address or screenshots of the messages.

What happens to what you type

  • We keep what you type into this form only to build the document. If you do not pay, it is deleted automatically after 2 hours. If you pay, it is deleted 24 hours after payment, together with the download link.
  • This assistant uses no artificial intelligence: the document comes from a fixed template, and your text is not sent to any AI service.
  • Payment is processed by Culqi. We never see or store your card details. The email you give for the receipt is sent to Culqi, which issues the receipt; Mis Derechos does not keep it.
