Indecopi’s Specialized Consumer Protection Chamber upheld a fine of 450 UIT against Empresa de Transportes Olivares S.R.L. Resolución 1238-2026/SPC-INDECOPI, dated 9 April 2026 in Lima, decided on second administrative instance a proceeding opened on Indecopi’s own initiative and decided at first instance by the Commission of Indecopi’s Cusco Regional Office (case 0031-2024/CPC-INDECOPI-CUS).

According to the resolution, at about 05:00 on 19 December 2022, one of the company’s buses (plate A2L-709), running the Cusco–Livitaca route, crashed at kilometre 27, in the «Totora Alta» sector. Indecopi’s supervision began from press reports on social media. When the proceeding opened, in November 2024, the count was 16 injured and 4 dead; the final count in the resolution is 25 passengers injured and 6 dead.

The Chamber confirmed that the company breached article 25 of the Consumer Protection and Defense Code (Ley 29571), which sets the general duty of safety. In its summary, the resolution says the company was found liable «por generar un riesgo injustificado a la seguridad y salud de sus pasajeros, en condiciones de uso normal de su servicio» (for creating an unjustified risk to the safety and health of its passengers, under normal conditions of use of its service).

The 450 UIT fine equals S/2,475,000 at the 2026 UIT (S/5,500). The soles amounts are our own calculation at the 2026 UIT; under article 113 of the Code, the UIT in force on the date of payment is used. According to the resolution, the calculated fine came to 17,229.12 UIT; 450 UIT is the legal maximum for a very serious infraction (article 110 of the Code), as Indecopi itself explains in Resolución 131-2026/CPC-INDECOPI-ICA. The Chamber confirmed the 450 UIT fine, though it changed the Cusco Commission’s reasoning. The resolution also orders the company to be entered in Indecopi’s register of infringements and sanctions.

As a corrective measure, the Chamber confirmed that the company must, within 5 business days of notification, «cubrir o reintegrar la totalidad de los gastos médicos en que incurrieron los pasajeros que resultaron heridos que no se haya cubierto hasta la fecha» (cover or reimburse all the medical costs of the injured passengers not yet covered). The order runs until the «máxima recuperación física posible» (fullest possible physical recovery) certified by a health specialist, in cases where the insurance is not enough. The company must prove compliance within a further 5 business days; if it does not, Indecopi can impose a coercive fine.

If you travel by interprovincial bus, see what insurance the bus must carry and what rights you have as a passenger. If a transport company puts your safety at risk, you can file a reclamo or a complaint with Indecopi.
