Indecopi fines Edunastours Nasca and its manager 455 UIT over a fatal dune-buggy crash in the Usaka dunes
The Commission of Indecopi's Ica Regional Office sanctioned Edunastours Nasca E.I.R.L. and its manager, at first instance, with a total fine of 455 UIT (S/2,502,500) over a dune-buggy crash in the Usaka dunes, Nasca, in which a foreign tourist died and four other people were injured.
This is a first-instance sanction and does not end the administrative process: it can be appealed to Indecopi's Specialized Consumer Protection Chamber. Indecopi's note adds that «La resolución ha sido apelada» (the resolution has been appealed), without saying which resolution it means. Either way, the fine is not final and the decision can still change. The 455 UIT is the total for the company and its manager.
| Entity fined | Edunastours Nasca E.I.R.L. and its manager |
|---|---|
| Authority | INDECOPI |
| Resolution | Resolución N.° 217-2026/CPC-INDECOPI-ICA |
| Fine | 455 UIT — S/ 2,502,500 |
| Resolution date | 5 Oct 2026 |
The Commission of Indecopi’s Ica Regional Office (ORI Ica) sanctioned Edunastours Nasca E.I.R.L. and its manager, at first instance, with a total fine of 455 UIT (S/2,502,500) for offering dune-buggy rides under conditions that put users’ safety at risk in the Usaka dunes, Nasca. The case arose from a crash on 1 July 2025 in which a foreign tourist died and four other people were injured. Indecopi announced the decision on 5 October 2026; it is recorded in Resolution N.° 217-2026/CPC-INDECOPI-ICA.
According to Indecopi, the company breached article 25 of the Consumer Protection and Defense Code, which sets providers’ general duty of safety. According to the police investigations cited in the note, the driver had no licence and no proven aptitude for the activity, and his lack of skill and an inappropriate manoeuvre were the decisive factors in the crash.
The company’s manager, César Eduardo Asto Llamocca, received an individual fine of 5 UIT for culpa inexcusable (inexcusable fault), for failing to check his staff’s technical capacity. The note does not break out the company’s share; our reading is that, taking the manager’s 5 UIT away from the 455 UIT, the company’s share is 450 UIT, which is the cap the Code sets for very serious breaches. The S/2,502,500 Indecopi gives is 455 times the 2026 UIT (S/5,500); at that same UIT, the manager’s fine equals S/27,500 and the company’s share S/2,475,000 (our calculation).
This sanction is first-instance and does not end the administrative process: it can be appealed within 15 business days to Indecopi’s Specialized Consumer Protection Chamber. The note published on Indecopi’s consumer portal adds that «La resolución ha sido apelada ante la Sala Especializada en Protección al Consumidor» (the resolution has been appealed to the Specialized Consumer Protection Chamber), but that sentence comes right after the paragraph on the Huacachina case and does not say which resolution it means. Either way, the fine is not final.
This case is separate from the Huacachina one: there, the same ORI Ica fined two companies, Aventura Sin Fronteras E.I.R.L. and Lima Experience S.A.C., 450 UIT each over a crash in May 2025, in a different resolution. We covered it in Indecopi fines two companies 450 UIT each over a tourist’s death on a dune buggy in Huacachina.
