Letter asking your employer to recognise the employment relationship (recibos por honorarios, internship or fixed-term)

We draft your letter asking the company to recognise your employment relationship in writing and put you on the payroll, if you are paid on recibos por honorarios or an internship agreement, or to recognise your fixed-term contract as indefinite. It quotes the rules word for word. This is not legal advice or representation, and it does not replace a Sunafil complaint or a court claim.

This is not legal advice or representation. The letter asks the company, in writing and with a deadline, to recognise your employment relationship: to put you on the payroll if you are paid on recibos por honorarios or under an internship agreement (convenio de prácticas), or to recognise that your fixed-term contract is considered indefinite. Depending on your case it quotes, in the original Spanish, Article 4 of D.S. 003-97-TR, Article 51 of Law 28518, or Articles 72, 74 and 77 of D.S. 003-97-TR. To see which cases apply to you, use the free intern-or-employee checker or the fixed-term contract checker. Sending the letter tells the company who you are: a Sunafil complaint is free and, in many cases, can be filed without giving your name, with or without this letter. Claiming benefits for past months is a labor lawsuit, which this letter does not cover.
Needed to deliver the letter by hand (with proof of receipt) or via a notary.
Hours, who gives you orders, what tools you are given, how much and how you are paid, what evidence you have. Use your own words.
For example, "10 business days."

It is a draft that you review and file yourself. It is not legal advice or representation. Delivering it is free and you do not need a lawyer; what you pay for is the drafting.
